Hi folks, Newbie here and I'm not quite sure where to start.

Basically my boyfriend is a permanent resident of US, he is in the process of divorcing his wife who is a US citizen. (My boyfriend is British). What can we do in order for me to go live with him when his divorce is through? What do we need to apply for? And how easy would it be as he is only a permanent resident of the US as he married an American citizen? Does he have to be divorced for a specific amount of time before we can make any plans?

I have looked on lots of immigration websites but to be honest its all too complicated for me to take in. Any advice would be greatly appreciated. Thank you in advance

Here's a good place to start:

USCIS - Family of Green Card Holders (Permanent Residents)

I don't think you have a lot of options right now as he is only a Permanent Resident and not a US citizen. All options will require a period of wait, unless you want to study or have a potential employer willing to jump through the work visa hoops.

He can petition for you once you two are married. As a green card holder there is not a visa immediately available for a spouse.

Once the petition is approved it will be approximately a 2 year wait before a visa will be available.

If he becomes a citizen during that time period he can upgrade the petition. Visas are always available for spouses of USC's.

Please provide some other information that may impact the petition processing / approval: How long has been married to his current spouse? How long has he been a green card holder?

How long has your married boyfriend been a resident ? There is a 5 year rule to file if he got his green card though marriage

Is there? Although I would assume once they became a citizen then there would be no rule.

If he divorces he will have to be an LPR 5 years before he becomes a USC. He also can't petition anyone else until he has been an LPR for 5 years since he became an LPR through marriage. How long has he been an LPR for?

10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot

Thanks for your responses folks. He has been married for 8 years and been living in the US for 2.5. Its so complicated.......grrrrrrrrrrr

This case is not so complicated at all.....might take more time than most, but pretty straight forward.
