Filing I-765 with the I-485 Packet question

Howdy!

We are finishing the assembly of our package(s) and are a little confused as to what to include with our I-765 form.

On the VJ guide it says to just include the I-765 within our package of the I-485. But some of the required documentation has overlap between the two forms.

First: The I-765 wants two passport style photographs, do we need to include two extra ones in addition to the two that are already included in the packet?

Second: The I-765 wants a copy of her I-94, which is also required in the packet for the I-485. Do we need to send duplicates for the two? I think I remembered reading that if we selected the ©(9) eligibility that this form isn't required?

Third: Never received an EAD. So we need to submit an identification with DOB and a picture. Would a Texas Drivers License be acceptable or does it have to be a Federal Government issued form of identification? (Do we even need to submit this since the packet will already have a copy of her passport in it?)

Just a little befuddled since it is asking for so many redundant documentations to be included in the packet. Not sure if those are intended to be required if you are submitting the I-765 by itself. Thanks!

1. Yes, you need 2 extra pp photo for I-765

2. Yes, you need to put an extra copy of I-94 with I-765

3. Just include a copy of passport. Its issued by the goverment and is a form of identification.

Also, for the I-131 they want the receipt from the submission of the I-485. Obviously we won't have that since we are filing concurrently, so do I just send the form with the Photos and a copy of her I-94 showing her last USCIS status prior to the I-485?

As soon as the I-485 is received it generates the receipt in their system and it all gets matched up in the database. I included a copy of passport for each form I sent in, plus evidence of entry (passport stamp from VWP in my case, I-94 in your case) too.

Good luck! Sounds to me you are good, and like previous people have said, every document with its requirement might go into different people's hand, so just submit everything as extra even though it sounds overlapping. All the best!
