All,

Would appreciate your help.I am residing in the US on my H1B visa, waiting for 485 date to be current. Also have EAD since 2007 when dates got current for couple of months. My fiance is a permanent resident. We are getting married in India soon. Had a few questions:

1. We would get the marriage certificate issued in India and she is planning to file a permanent resident application for me (Spouse F2A category). Is the marriage certificate issued in India good enough for filing a F2A when both me and her reside in the US?

2. Can we "register" our marriage in US. If we have a certificate issued in a foreign country (India) while we both reside in the US, is there something that can be done to register the marriage here so that we have an official document issued from our state of residence (NJ)?

Not sure about registering it here but the Indian marriage certificate as fine as long as it is a legal married. If it isn't in English it'll need to be translated but otherwise you're good.

10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

11.02.2012 - Mailed I-751 packet to VSC
11.08.2012 - Checks cashed
11.10.2012 - NOA1 received, dated 11.06.2012
11.17.2012 - Biometrics letter received for 12.05.2012
11.23.2012 - Successful early biometrics walk-in

05.03.2013 - Approved! Card production ordered!

just get it translated and that's it. That is the requirement.

Me and my wife did the opposite and got married in the USA and now getting the US marriage certificate registered in our home country....trust me, you want to avoid this, it is a headache :D

24 Jun 2013: NVC case number received

25 Jun 2013: DS-3032 sent

27 Jun 2013: AOS bill received and paid

xx Jul 2013: AOS package sent

09 Jul 2013: DS-3032 accepted

11 Jul 2013: IV bill received and paid

21 Jul 2013: IV package sent

11 Oct 2013: Case completed

28 Oct 2013: Interview appointment received

Yes, a foreign marriage is valid in the US as long as it does not violate public policy (i.e, polygamy, incest, etc.).

2. Can we "register" our marriage in US. If we have a certificate issued in a foreign country (India) while we both reside in the US, is there something that can be done to register the marriage here so that we have an official document issued from our state of residence (NJ)? There is no such thing in the US. No one needs to register a foreign marriage that is already valid. Your Indian marriage certificate is all you need to show a valid marriage in the US.
