K-1 approved can I still visit the US

Timeline

I live in the UK and my fiancee lives in the US and we have just had our K1 approved :D. I have received my forms, checklist etc from the US Embassy and am in the process of completing them.

However I am planning on visiting my fiancee for thanksgiving and I am concerned that I may not be allowed to enter the Us. Is there anything people could suggest that I bring with me to help prove that i plan on returning home and that it is just a holiday. I live with my parents which means no lease or utility bills. Any help would be greatly appreciated as my fiancee is extremely nervous that I wont be allowed to enter.

Gary, you say your K1 has been approved but then that you have just recieved your forms and checklist from the Embassy. I'm not sure if your approval is really your K1 or if it's just I-129F approval.

If your K-1 has been approved and you have a visa then you can't visit the US, entering will activate your visa and you will have to marry and apply for AOS ect.

If your approval is just the I-129F then you can try to visit the US using the visa waiver programme. You will need proof of your ties to the UK, a letter from an employer saying when you are expected back would help as would details of bank accounts. If you have an appointment to go for interview at the US Consulate this might also help to prove you intend to return to the UK.

Remember there is no guarantee you will be allowed entry to the US and be prepared for the possibility of being sent back at your own expense. Some members here have managed to visit during the process. It's a gamble.

Sorry I meant we have had our I-129F approved and not the K1 visa itself.

So many letters a nd numbers it gets a bit confusing.

You have a valid concern, your chances of being admitted to the US rest on your winning personality and convincing ways when you speak with the immigration officer at the POE. The key to convincing the officer that you will return to the UK will be your plans for a brief, temporary visit. Your ties to the UK are next to useless, you are on record that you will be severing all ties that require you to return to the UK in the near future.

You may want to route your travel through Dublin or Shannon, which have USCBP pre-clearance operations. If you are not admitted the trip back home will be shorter.

Hi,

I asked the same thing to the lawyer that Adam and I have hired and he said though legally you can enter the states while having a K1 petition in progress, he advised NOT to enter as it is a risk that you will be denied and so you'll waste money on a flight and they may also suspect you will not leave. He said that it is best to wait out the K1 application.

I know it's frustrating as I wanted to go to Adam's brother's wedding but couldnt...it's the waiting game unfortunately.

Not true. Many have entered with no issues at all. Stating generally would IMO be an overstatement and much depends on circumstances and the CBP officer.

I've seen two very different answers to this same question: is it okay to visit the US while your visa application is being processed? In some threads it seems like people are encouraging it stating that you are showing that you are in an ongoing relationship and that USCIS isn't trying to keep a couple apart from each other. In this thread, it sounds like people are warning that it may look bad visiting while you are waiting for your visa.

Now, it may make a difference because you're approved and it's now making its way to the Embassy; however, I don't see why it should matter until you have your visa in your hands, in which case you can only enter the country once and then need to get married within 90 days.

Honestly, being a US citizen I don't know what non-citizens have to go through when entering US customs. I do know that many people have come here to visit their fiance(e)s while their applications were being processed and have not had troubles (my fiance just came to visit last month). As long as it's for a short stay, I don't see why it should be a problem.

I'm not a lawyer, I don't know the laws and am continuously dumbfounded by how all of this works, but based on common sense and my own experience, I think you should be okay.

Just fyi, I visited US after obtaining my Packet 3 (before returning said Packet 3 to the embassy in Malaysia) on my B1/B2 visa. The POE officer just asked to see my return ticket and my occupation, questions which were asked when I entered US earlier (before the K-1 process).
