Hi I have a unique situation (maybe not) and I am hoping that this forum will help me with my issue :). The situation is that I am a Canadian permanent resident currently living and working on H1 in USA. I am planning to move to BC Canada in few months. I recently got married and my wife is planning to come to US on a H4. I am going to file her residency for Canada as soon as I make my move to Canada. My question is, can she live in USA on a H4 without any issues till her residency is under process while I live in Canada? Also as I work in USA and will be commuting from Canada for work and also to meet her, there wont be any issue in crossing the border? Thanks in advance.:)

What country is she coming from? It may be that she can join you right away in Canada on a Temporary Resident visa. Those are issued for 6 months and are renewable. You may want to apply for that right away as it could be possible she could join you in Canada. Canada is a lot more sympathetic to keeping families together. Why not check over the Canadian immigration website at http://www.cic.gc.ca and see if that is a possibility.

Her H4 will be as good as your H1 is.

Thanks Kathryn41 for your response.:) She is coming from India. I just looked at the website and I could not make out any difference between TRV that you mentioned and a visitor visa. They seem like one and the same thing. I heard that canada might not approve her visitor visa as I am a permanent resident and they would want her to come there after she becomes a resident which takes around 10 months. Again I just heard this from someone, I might be wrong and I sure hope that I am wrong and she can come directly to canada on a trv or visitor visa. Thanks for your response and please let me know if you have any more insights on this.:) Appreciate it.

Thanks Boiler for your quick response. So what I understood from your comment is that she can live in US for the time her residency is under process on a valid H4 and it wont matter if I am in Canada as long as I have a valid H1. Thanks again. I wanted to confirm this only.
