hello guys! im a newbie here, been looking for a place like this, hoping sumbody can enlighten me as to what will I do at this time of my life. I was petitioned by my US citizen father last 1999 with priority date of July 1999, by August they said that our visas were already cabled to the US embassy here in the Philippines, it was expedited since I was turning 21 Sept, 19 of the other month. but then they told me to wait for my notice for interview, but then all I received on Sept. 15 (Friday) was my siblings papers, knowing I was the one to be rioritized. so I turned 21 Tuesday of the other week waiting in vain. our place is far from Manila n we don't have available phone lines that could easily contact the US embassy. so i went then to the US embassy wednesday aftr my birthday and inquire about my papers n like it was the end of the world when they told me i should have gotten to the embassy even without a notice so they could just have sent me to a plane just to turn 21 in the US. I was devastated for such, n we inquired about how come my papers wrent available where in fact i should have been prioritized and they told us they have sent a notice which i never received at all. so i waited, til such time that I consulted a lawyer last 2007 (i have a common-aw husband n a daughter then) who gave me two options during the interview: that i could go to the US in 18 months n pay $11500 minimum, go back to the philippines n marry my husband, n ill b able to getthem in 3 years or i could use my profession (Im a Californis NCLEX passer) and apply as a family n wait for 3 years so we cud go to the US. what better option for me to have is to go to the US together with my family right? then i met an employer who even encouraged me to get married so we cud file as a family since he was sponsorng nurses for US then, so i took the oppurtunity, got married, files for our EB3 visa by December of 2007. By February of 2009, I received from NVC that they are already ready to process my papers as single adult daughter of a citizen. so i had to send my marriage contract to the NVC. by July 2009, i found out that my application for EB3 was denied dut to incomplete documents from my employer.i have already my visa screen, my NCLEX, my CGFNS, and all the necessary documents that will be needed by a US nurse applicant but it was the irresponsible works of the employer which lead me to this situation. it was reallly double jeopardy in my case coz, i sacrificed my single petition, but then, getting married kept me stuck for longer years. my question is, how is now my case? is there a way by which they will give consideration in my case? will i have to wait again for many years? i have been waiting for 13 years already, won't they consider that?thanks a lot for replying, may the good Lord bless you for giving an enlightment to me.

What do you mean by "i sacrificed my single petition?" What happened? Was the I-130 withdrawn? Was a decision actually reached? Did you inform the NVC that you got married and changed the case to an F-3? Is the I-130 that your father filed in 1999 still active?

@maricor_0216: Try to find another employer. Your EB petition filed in 2007 may still be transferable to another employer. But if you can afford it consult a good immigration lawyer. You should have pursued the original FB petition when you were below 21yo. The law provides 45 days grace period for age-out children. Good luck.

Not back in 1999.

The 45 days grace period was created after 1999, so it does not apply to an aged out child in 1999.
