When I filled out my W-4 for my new job. There is a spot that asks for you to answer single if your spouse is a non resident alien. I guess that this status does not change until after you receive your green card, does anyone know this answer?? I have attached a screen print of the document.

The W4 is just for your employer to know how much tax to withhold from your pay. It does not go to the IRS. If they take out too much, you get a bigger refund. If they take out too little, you have to pay more. It can be tricky finding a balance during transition from single to married. I would go to a tax expert to evaluate your situation.

Its not hard to figure out your taxes - do a spreadhseet - total income expected; less your exemptions (married filing jointly); less your std deduction times the tax rate will give you a rough estimate of your taxes. If you own a home then you can do a schedule Aand calculate deductions using schedule A instead of std. deductions. Then, you can check your federal deductions on your paycheck against what your taxes will be (estimate them for 12 months) and figure out if you want more tax withheld(lower your exemptions) or less tax withheld(increase your exemptions.) We put down Married. Keep in mind this document has nothing to do with USCIS, only the IRS cares about this (and even they dont care too much since this is an estimate, you use actuals when you file your taxes).

I believe there can be a penalty and interest involved if you owe too much.

No, that status will change when the alien has been resident in the USA for long enough to be a US taxpayer under the tax laws.

It can change even sooner than that, if you wish - you and she can declare her to be a resident alien for tax purposes before the law requires her to be. Some people save a lot of money that way.
