Forget the K3. Many years ago, it was faster than the CR-1, because extra paperwork has to be done after you immigrated to the USA. However, the CR-1 is now the only viable visa. By filing the I-129F after the I-130 your I-130 petition will be pulled out of line and delayed, and then at NVC stage, the K3/ I-129F will be closed and you will have to proceed with the I-130 anyways. "were the marriage took a place" means exactly that- in which city/ state/ country did you get legally married.

ou, the American citizen, must file Form I-130, Petition for Alien Relative, for your spouse with the United States Citizenship and Immigration Services (USCIS).

USCIS will send you a receipt notice (Form I-797).You then file Form I-129F, Petition for Alien Fiancé(e), for your spouse with USCIS. If your spouse is planning to bring his/her unmarried children under 21 years of age to the United States in K-4 status, you must name the children in the I-129F petition.

If USCIS approves your I-129F, it will send the petition to National Visa Center (NVC).

After initial processing, NVC sends the I-129F petition to a U.S. embassy or consulate in the country where your marriage took place.f your marriage took place in the U.S., NVC will send the petition to the embassy or consulate in the country where your spouse will be applying for the K3 visa. This is usually the country of his/her nationality, but could be another country if there is no US embassy or consulate in that country, or there is one but the post doesn't issue visas.

After receiving the I-129F petition, the embassy or consulate will notify your spouse, with instructions regarding medical examinations, visa interview and supporting documents (proof of marriage, financial support, etc.)

Your spouse must attend the visa interview, and if all goes well, will receive K-3 visa on his/her passport.

Forget the I-129f, first it's not longer in use, second your only option is I-130 going the CR-1 route, I know you are reading the info posted here, but, it is not accurate anymore. I wish you would listen to what everybody is trying to tell you, the way you are trying to go IS NO LONGER IN USE, You cannot fill a I-129f anymore, it use to take as long to process as the CR-1 so it is obsolete.

if your already married them you only file ONE form 1-130 cr-1 visa,the 1-129f is used only for fiance'e not married yet thats a k-1 visa, you still see k-3 in the guides but it's no longer used since two years ago.if you don't want to listen to the vj members then do it your way 1-130 an1-129f togather

Hello Tebessa16! Since you are married you DO NOT file I-129F form. You would need to file the I-130CR Form ONLY!

yes well i know all whole the procece right now i do understand all of it thanks so very much but well i have friend's of mine they do the i 130 but it takes for ever to be done so i must file the i 130 and after that I 129f

I 130 it take so very much long time that's what my friend's told me they are on this procece too

Seems you are sold on the K-3 visa...so to answer your original question:

U.S. Petitioner sends compiled I-130 package to the Chicago Lockbox.

U.S. Petitioner Receives first Notice of Action (NOA) acknowledging I-130 petition has been received

U.S. Petitioner sends compiled I-129F (along with copy of the I-130 NOA and transfer notice from the Chicago Lockbox) to the USCIS Dallas Lockbox who will forward the package for processing.

Hi tebessa16,

Once upon a time you would file the I-130 and then file the I-129f. This would get you a K-3 visa, which is what your friend suggested. It used to be that the I-130 took a long time to get the CR-1 visa. That is no longer the case. The I-130 is now being processed faster than the I-129f (K-3 visa), You can still file the I-130 and the I-129f if you want, but it will not make your process go faster. What will happen is that the government will cancel the I-129f and only continue with the I-130 petition. Your friend will probably have this happen as well. The K-3 visa used to be faster, but when the I-130 petitions started to be processed faster than the I-129fs, filing the I-129f as well as the I-130 no longer made sense.

So, what people are trying to tell you is that now, you no longer file the I-129f after you file the I-130. You only file the I-130, otherwise you are just wasting your time and doing unnecessary paperwork.

It is important to realize the the immigration process does change and you need to keep up on what these changes are. The people here are giving you good advice. You now only need to file the I-130 petition. When that is approved, your wife will then send in more information and you will be sent a notice for an interview date. When the request for a CR-1 visa is approved, you will travel to the US and get a green card shortly after you arrive in the US. There is no longer any need to file an I-129f if you have filed the I-130. It is no longer a faster process and the I-129f just gets cancelled.

The i 129f is no longer available for a k 3 visa. they no longer issue it!!!!!!! if you can;t understand what we are saying get your wife here so she can understand ..YOU CANNOT APPLY FOR THE I129f FOR K3 VISA...THAT VISA IS NO LONGER BEING ISSUED. YOUR ONLY OPTION IS THE I 130!!!(sorry for yelling everyone he isn't understanding what people are trying to tell him)

so they don't issue k3 k4 anymore? then how come they still have it on their website? i was thinking of filing I-129f coz i only filed I130 for my wife, i didnt file for my daughter, was thinking if i file i-129f my daughter could get a k4 visa even if i did not file i130 for her... but been reading things here on vj. everyones saying that i-129f is obsolete....

It shows that you were definitely together but it doesn't speed up the case. If the baby is born before your interview, the household size for the affidavit of support will go up by one.
