HI,

My name is kumar, I am in student visa(F1) married a US citizen(my relative) on Dec-2011. i applied for GC on aug-2012, yesterday oct-'12 my EAD status was "card/document production" and we scheduled for an interview. My question is, after getting EAD, do i need to change my status F1 to GC? can i work full time in anywhere in US. cause i finished Master.

Note: My F1 visa expires Jan-2013.

Please let me know, how to deal with my status.

You're asking whether you have to continue green card process ? Of course, EAD is somewhat temporary, if you stop it will be void. If you're asking about something else, please explain what it is...

Hey Kumar:

The advice I've got from the international office at our school was this:

You have two options when doing AOS and you can choose and let your international office know because they either electronically document your decision, or they make you fill out a form and sign. The two options are:

1. you want to maintain your F1 status even during AOSing

Drawback: you cannot work full time anywhere, only part time on campus as you are an F1 student. You are paying international tuition fee (if you pay any- varies by programs) and you have to be registered for 12 units in order to be a full time registered student.

Good side: if for some reason your AOS fails, you can stay and continue on with your studies on your F1 status until your I-20 permits.

2. you abandon your F1 student status

Drawback: if your AOS fails for some reason you have to immediately depart the United States, and cannot continue your studies anymore as you are no longer hold an F1 status. Chances that you can apply for a new F1 visa and status is minimal at best as you'll have a record that you have tried to immigrate to the US before while F1 students are supposed to show strong ties to their home country which they do not wish to abandon

Advantage: you could start working full time with your EAD if you wanted, you don't need to register for full time 12 units to maintain your student status (note: if you want to continue your studies, you are still not a resident so your tuition still would be that of an international student).

Well, this is your two option. You think it through. I, myself, decided to stick with the first case, let me be an international student all along until I don't get a final decision. This way I can stay to be a student if AOS fails, if not, even better. But at least I would be on the safe side. But really, every one of our circumstances are different, Kumar, so you know your situation better.
