hello, i am looking for a bit of advice. a little backround. my son, a US citizen met a Japanese student/ citizen in hawaii. they were in a relationship(not married) got pregnant and she(the mother of my grandaughter) moved back to japan to have the baby.(3 years ago) the child is only Japanese citizen.there is no chance of reconciliation for mother and father. my question is, is there a way for the japanese mother and child to get US residency/citizinship. does the japanese, unmarried mother qualify for this for having a dependant child? does the child qualify? do i have any grandmother rights to file. the mother and i have a VERY good relationship and i love them both very much. she wants to raise the child here in america. i want to do everything i can to help make this happen.

The child would be a US citizen by birth, wouldn't she? The mother would just need to register the birth (CRBA) and then apply for passport/SSN.

I don't believe the mother can qualify to live in the US through the child until the child is themselves 18+ and can then petition their mother. The mother has no right to live in the US just because their child is/maybe a USC sadly.

Your granddaughter has claims to US citizenship through her father but he has to first file a CRBA. Nothing can be done for the mother unless she gets married to USC/LPR, her LPR/USC parents, USC siblings or USC child over 21 files for her, or she gets a work visa.

Grandparents can't petition.

The child is eligible for US citizenship and can petition for their mother when they are age 21 (not 18).

1. where does a person file a CRBA?

2. does it have to be father/US citizen?

3. the child would be a US citizen regardless of where she was born?

4. do we need to do CRBA prior to applying for US passport/SS#?

The mother may need a DNA sample from your son.
