Advance Parole for K1 holder

Timeline

Dear All, Maybe somebody has information about this: We are awaiting for NOA2 but in order to plan ahead, we would like to know if, once I (the foreign fiancee) go the USA and we get married and file the AOS, I can leave the country based on an Advance Parole, in order to have the religious wedding in my country with my family. I have read some comments about Advance Parole but it is not clear to me if it is only for urgent trips (business, or sickness, etc) out of USA. Could I get approval for a wedding trip?

Advance Parole is simply an authorization to travel outside of the US while a Green Card has not been issued.

You, most definitely, travel to your country (or any other place that's not US territory) while on AP for whatever you'd like to do there yes.gif

You file for the AP and EAD with your AOS application. There is no fee to add the AP and EAD when filed with the AOS. But it will take about three months to get the EAD/AP combo card once you've filed for them.

Yep once you get AP, you are free to leave the country as many times as you want without forfeiting your K1/AOS status.

Just might be worth mentioning timeframes. Once you marry here in the US, it'll take at least a few weeks to get the paperwork prepared and sent off. Unless you have time before your marriage to get it prepared (Which I'm sure most people having gone through this will laugh!). Once the AOS/AP/EA applications are sent off (You should always ensure you apply for all three at the same time as the AP and EA (Employment Authorization) fees are waived when you file at the same time as AOS), it will take 50-80 days to get AP.

Just just be mindful of the time frames involved, you won't be able to leave for several months until you get AP, taking into consideration:

1. Time between arriving into the US and getting married (typically 2 months).

2. Time after marriage to prepare paperwork (2 weeks).

3. Time for processing (50-80 days)
