Please be advised that the National Visa

Center (NVC) has received your inquiry

and the attached I-797 Notice of Action -

Approval Notice. Unfortunately, we do

not have record of receiving your

approved petition from U.S. Citizenship

and Immigration Services. The NVC will

contact USCIS on your behalf for

information on the location of this

petition.

Allan-nhez, to make a long story short, I just called the NVC and suddenly our file was there. It wasn't there yesterday morning; it was there yesterday evening.

I'm a dual US/Hungarian citizen (both by birth; Hungarian citizenship verification TBA), and my husband is a dual British/Irish citizen (by treaty) from Northern Ireland. We are atheists.

All advice is given pursuant to the Disclaimer that you may read at the bottom of each forum page.

LATEST STEPS:

28 Jun 2013: POE Houston

08 Jul 2013: SSN received (at SSA office)

07 Aug 2013: Green Card received

27 Feb 2014: Whoa, life happened. Planning move "back home" together to Republic of Ireland by end of April.

29 Apr 2014: POE Dublin through Heathrow

15 May 2014: Received formal residency/work permission (GNIB card with Stamp 4, one year renewable) for the ROI

That means they are looking into it. They are calling the USCIS. Don't be surprised if you get an e-mail that says your papers are being "retained" somewhere. It doesn't mean your papers are not being sent to the NVC. It is bad wording. All it means is that the office held your papers until they sent out a batch of files all together. In fact I received the "retained" e-mail AFTER my papers had already been mailed. Someone at NVC is sending out e-mails with old information. Probably someone calls and makes a note on the file, and someone else sends the e-mails. Don't worry, if your file is approved for sure and you see no change in case status, your file will show up.

I did, and I talked to more than one ISO. They could put in a service request (which I have not heard anything about, but it is moot now), and they could assure me that my petition was definitely approved. I suspect Houston, being new at the I-130s, is holding a lot of work for supervisory review, and then batching the files to ship them out once a month.

I found out more about the case by working through John Cornyn's office (I wouldn't touch Ted Cruz with someone else's ten-foot-pole, the #######). The very sweet immigration liaison called Houston (we can't do this) and found out exactly when the file was actually sent out. You (that is, the USC) could consider doing this too; fax in the privacy form you can find on John Cornyn's website ("help with an agency"), a copy of your NOA2, and a letter explaining the delay and requesting that Houston not sit on approved files.

SEVEN WEEKS from approval to receipt at the NVC, after getting the Senator's liaison involved and being assured our petition was uncomplicated and normal? I can't think what else it might be. I can't imagine how long a complicated file would take.

i think, for Houston, it smells like they are sitting on approved petitions and only shipping out once a month.

That's what it smells like.

That sound about right. I found out that the local field office that had my file and where I attended my interview for the I-130 did not send the file to NVC for about 20 days after the case was approved. A tier 2 rep at USCIS told me that the local field offices usually hold all the approved petitions and send them in a large batch to NVC. My NOA2 had a notation that my file would be forwarded within 30 days.
