Hello VJ family,

We have been in AP for over six months. We are tired of waiting, it is an absolute torture. We Are thinking of getting married and submitting a new application. So, do we cancel the k1 process and how?

Thanks in advance for all your help.

I-129F

July of 2010: We met in Eritrean when I was on vacation.

August of 2010: Returned to U.S and we spoke on the phone everyday and still do (very costly).

December of 2010 to January 2011: went back to Eritrea to see him.

January 11, 2011- Engaged.

March 2, 2011: I-129F sent

March 13, 2012: Second interview. Placed on Administrative Processing.

October 16, 2012: Case sent back to USCIS

November 16, 2012 Case reaffirmed and sent back to the Department of State (according to the USCIS SITE)

November 28, 2012 Vermont Service Center received Petition back from Embassy.

March 2013- Returned K1 validity expired. Here we go again.... !

I-130

March 15, 2013 Married

April 29, 2013 Filed I-130

May 2, 2013: Received NOA1 via text/email

May 6, 2013: Received NOA1 hardcopy in mail

XX- XX, 2013: Received NOA2 via text/email!!!

XX- XX, 2013: Received NOA2 hardcopy in mail

XX- X, 2013: NVC received file

XX- X, 2013: NVC case number assigned

I don't think that getting married will change you being in AP.

I don't think that getting married will change you being in AP.

Getting married and filing a new petition will take at least 7-10 months from the day you send the petition to interview. And then at the interview you will only be put in AP again. Why in the world would you want to do that? Filing a different petition will not change the fact they they need to do additional background checks on your spouse!!!!!!!!!!!!

Unless you enjoy AP I would advise you stick with the K-1. The security checks have to be done no matter if it is a fiance visa or spousal visa being applied for. If you cancel the K-1 you go back to square zero and after many months, when he has the interview, the AP starts again, at square zero.

stick to the k1, even if you go the marrige route same thing will happen at the end he will still be put on ap, it will even waste more time and money for you guys. Dont regret it later if this happen, since you have all the advice from everyone here its good to take the advice. good luck

If both of you really wants to get married, nothing can hold you to get married. But there is no guarantee that as you process for another route that it will get approve, it might be put back in AP. But remember if two people truly love each other they make a way to be just in each others arm. Whatever decision both of you choose may the Lord will guide you and bless you both. my lawyer told me. there's something called residence time for each country. usually 6 months. some countries dont have any residence time. But if you go to his country and stay that time, then technically you can file your marriage papers from there. should be much quicker.

You'll have to go through AP again after the CR-1 interview. Plus of course the starting over from scratch with spousal petition.

I hope you hang in there no matter what you decide.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

not might be out back in AP..WILL be put back in AP..the background checks will still need to be finished

this won't solve the problem of being put back in AP
