K-1 to Marriage to AOS... where does SSN come in?

Timeline

My then fiance entered on a K-1. We got married within the 90 days and sent in our AOS (I-485, I-765 & I-131) also within the 90 days. The SSN topic is confusing. Does my husband get his SNN with the AOS package? Or do we have to apply for that separately? His I-94 expires Oct 13, 2012. Thanks in advance.

Unfortunately, he'll now have to wait until the green card is in hand, since the I-94 is expiring in a couple of days.

As a K-1 Visa Holder you are eligible to receive a SSN upon producing a valid I-94 (unexpired). Do

not wait until you only have a few weeks left until your I-94 expires to file for a SSN. Many SSA

offices will not allow you to file for a SSN if your I-94 is about to expire (generally 14 days prior

to the expiration on your I-94).

Unfortunately, he'll now have to wait until the green card is in hand, since the I-94 is expiring in a couple of days.

Green Card or EAD, whichever comes first. And yes, this is probably too late. You can try to go to the SS office first thing tomorrow morning if you want (with the required documents as explained in the VJ Guide), but it's highly possible that they won't issue your husband a SS# as his I-94 is expiring very soon.

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

You have to apply at an SSA Office, I would call your nearest office or go in person to see if it is too late.
