Semantics.

She would be issued a new card sicne the other can got "destroyed" in the lake. The numbe rremains the same.

OP has every reason to destroy her card. She can get a replacement for free of charge. The num ber stays teh same, the do not work stays on teh new one but anyone can get a new card even if a fee.

OP, own up to your part of the dance. Everyone says Lawyer but that is costly and not having money is partly what got you into this debacle, good luck.

PS: A lot of relationship needs to learn from this post. Folks need to understand that you are still responsible for some certain things even if you're in a raltionship, wedded or otherwise.

First lets be clear on something the card did not cause the OP the problems she has. My responds was being directed to the poster who stated she should have destroyed the card when she stop being a student.

Ok I appreciate all the advices, but some of you guys are being very unfair, since you don't know the storie, first of all I'm not trying to sound like a victim here, I was just asking for your advice, I mean seriously, why would I lie to everyone on here?? I needed an advice ok??I'm not lying to anyone,I feel so frustrated. I AM NOT THE VICTIM and I'm aware of that, I chose to stay with my boyfriend but don't you get it?? I had a Tourist visa for years, and I never tried to live in the USA. I never cared abt it, but I fell in love with my boyfriend, you have any idea how It feels to be in another country, not having anyone but just the person you love. I didn't know what to do, I know it was not right that I basically lived with my boyfriend for that period of time but I wasn't trying to hurt anyone, I mean I was not working or applied for a job in that period. That's why I'm flat broke right now... I used all my mexican credit cards to pay for my stuff for a long LONG TIME!!!! Then when I didn't have any money left, my boyfriend took care of me... I mean we would go on trips together since he was off for MONTHS.. I never tried to take advantage of my Tourist visa I JUST WANTED TO BE WITH MY BOYFRIEND... but still I know that MANY PEOPLE use their tourist visa to stay in the USA, get a job and they don't even leave EVER!! I did not do that... I'm also aware that I shouldn't have applied to get a"TEMPORARY" job.. I mean,I WAS SO WORRIED ABOUT MY SITUATION AND MY LIFE THAT I FELT TERRIBLE THAT I HAVE SPENT EVERY PENNY I HAD WHEN I FISRT MOVE IN WITH MY BOYFRIEND..come on, if you guys are telling me that I AM THE ONLY PERSON WHO DOES THAT IN THE USA !! YOU ARE WRONG!! Because everyone knows that TONS , MILLIONS OF PEOPLE ARE ILEGAL IN THE USA, and don't give a sh.... about their immigration status they don't even pay taxes, THEY ARE ILEGAL AND THEY ARE FOOLING THE GOVERMENT THE WHOLE TIME.. AND NOW YOU ALL THINK THAT I'M A CRIMINAL BECAUSE I APPLIED TO GET A TEMPORARY JOB FOR "2 MONTHS" I WAS NOT GONNA STAY THERE.... I'M NOT LYING TO ANYONE ON HERE.. there is no reason for me to do that since I NEEDED AN ADVICE OK? I must be very stupid not to tell the truth .. I WOULD BE LYING TO MYSELF...

Im not the victim but I am not a criminal either IF I Kept THAT SSC It's because I WAS NOT AN AMERICAN CITIZEN AND YOU GUYS SHOULD KNOW THAT YOU NEED YOUR SSC to almost anything.. I HAD A BANK ACCOUNT SINCE I WAS AN STUDENT , I NEEDED MY SSNUMBER AND I DIDN'T KNOW THE NUMBER,OFCOURSE I KEPT THE CARD WITH ME ... now i think abt it and realize that it was very stupid of me.. bc you guys are right.. I was not planning on getting a job or was trying to take advantage of it so I shouldn't keep it. I didn't force my boyfriend or asked him to scratch it off.thats why I was so upset, even if i was not using the card at all.. I DIDN'T LIKE WHAT HE DID.. BECAUSE I WANTED TO KEEP MY CARD W ME ... the officer said that He knew I didn't work... He said: don't even worry about that... the problem here is that you had a false document in your hands... so that's the problem here.. not that I got a job when I was on my tourist visa.. I have heard many stories at the american consulate, TONS OF PEOPLE TRYING TO GET A GREEN CARD OR CITIZENSHIP, EVEN THOUGH THEY WERE ILEGAL FOR YEARS IN THE USA.. getting married to an american citizen in order to fix their situation or even worst, getting caught selling drugs or stuff like that, they get deported..and after requesting a waiver they get approved?? I mean is that fair??

so please if you are just gonna be rude and will try to make me feel guilty, then I have no interest in what you have to say to me... if you are on this forum it's because you must have done something wrong as well, otherwise why do you need a waiver?? I don't know your situation but I'm nobody to judge anyone.. every storie is different..

Some international student like you were are issued ssc for identification in a collee institution but that ssc is not valid to work.The denial of your fiancée visa is traced back to your history of holding a " fake document ".If you alter any government official material to your benefit it is considered fake and misrepresentation...

We all might understand you didn't do it but you are the one holding it.Being on a visitor visa and trying to seek employment in US is a violation of immigration acts but your case is not that worse...You could win the case if you have a good lawyer.Sorry you are going through this but just pray and you get your visa and don't let anybody mess with your official docs in the future

Your topic can be read by everyone on this site, not just people in the waiver forum... just out of interest.

Honestly, a lawyer is all any of us can advise. Your "lie" with the fake document is not something most people deal with that I've seen. Usually it's overstay, or deportation and stuff like that.

I truly wish you the best. I hope that because you've never used it you'll be able to get your waiver approved. You did the right thing by never using it. Out of interest for other people reading, you're not supposed to carry your SSN anywhere. Not only as a visitor or whatever, any of us. You're supposed to put it somewhere safe and occasionally you might get asked to produce it but if you ever lost your wallet the person that has it can steal your identity so easily by having that card. I personally have a photo of the number written on a piece of paper available for me to see online if I need it and forget it. If I ever need the original card I'll take it wherever it needs to go but most places just want the number.

I really think you need to see a lawyer. Everybody on this forum is here voluntarily and are not licenced attorneys and the kind of advise you need only a licensed attorney who specializes in Mexican immigration issues can provide. Just so you know, not everybody here needs a waiver like you do. Mexico is very, very tough on approvals and getting the waiver is not easy. If you choose to pursue the waiver you are probably going to need to seek the advise of an attorney. In every forum you are going to get answrs you like and don't like and also helpful advise and not so helpful advise. Sort through the advise and use what you can and the rest just ignore. I wish you the best!!

I think you are mixing several topics here, so let's address one-by-one:

1) In your initial post and several other ones you keep stating that this is unfair what happened to you and your main argument is that other people doing this too.

2) What to do next.

You need to separate these topics. People react to both of them and react fairly.

1) Let's start with the 2nd topic: what to do? It is answered: you need a really good lawyer to apply for waiver. End of conversation. You committed inadmissible situation and you have to deal with this. You may be able to deal with this or not but this is currently the only way.

2) You keep saying that this is unfair. And I state as well as other people do: THIS IS ABSOLUTELY 100% FAIR. This is absolutely false argument that if there are other illegals that get away with this you should be able to get away with this too. There are criminals that get away with murder or theft or robbery. This does not make it right from everyone else to commit a crime. This is just an analogy to explain why your argument is 100% false. There are more decent people that chose legal route. You will see 100's of VJ members here from EU and Canada that could enter on Visa Waiver program and stay and adjust status. They rather chose the legal, honest route. Everyone here misses their spouses/fiancees. Look at couples from Morocco that fight to be together for years and yet choosing legal route. While my fiancee and I were waiting for K1 approval she came to Tijuana, Mexico all the way from Russia for 4 months. I rented apartment and commuted to work in San Diego every day waking up 3 am in the morning. We also chose legal route. Why are you different? So all it is you are suffering from consequences of trying to take short cuts. I do not feel you will find a lot of sympathy here considering that people suffered enough here to be with their loved ones without taking hort cuts. You are no he only one. The best we can do is give advice per first part but do not expect people being sympathetic with you cry about being unfairly treated.

I NEVER SAID THAT I WAS THE VICTIM... I CHOSE TO BE WITH MY BOYFRIEND.. BUT I WAS PLANNING ON COMMING BACK TO MY COUNUTRY... I have proof of that since they saw my ticket in hand... I was comming back to my country after Newyears.. (3 months later) I WAS GOING TO SETTLE DOWN IN MY COUNTRY..BECAUSE I KNEW IN MY HEART I DIDN'T BELONG THERE...I KNEW I DIDN'T HAVE A LIFE THERE.. SAYING AT HOME ALL DAY LONG.. NOT GOING ANYWHERE BUT JUST TO WAIT FOR MY BF TO BE HOME WITH ME.. WASN'T A LIFE...IT'S NOT THAT I WAS HAVING A GOOD TIME AND MAKING MONEY WHEN I WAS ON MY TOURIST VISA... I DID NOT WORK OR DID ANYTHING INDECENT LIKE YOU SAY... I MADE A MISTAKE AND I'M PAYING THE CONSEQUENCES! SO I WAS NOT TAKING A SHORTCUT...I'm not looking for sympathy on here either.. I found a temporary job just to make money for the holidays which was not right either. Ease up off the caps lock. You are currently shouting unnecessarily at people and it makes it seem like you have no respect for others here.

Anyway you got answers to your situation already were you either file the appropriate waiver or lawyer up since your case appears a bit difficult.

Question: if there is no life for you in the US (your words) why are you trying to get back over there?

I said I was sorry !!! why aren't you reading what I say?? when i send emails I always do that.. and didn't know that I was yelling.. maybe it's the same when Emailing ppl. Idk.. and I said I didnt have a life.. because I did not work, I did no have money, I did not go anywhere.. I was literally sitting at home the whole time... knowing that I was not doing the right thing. my boyfriend was gone all day at work.. that's why I meant.. why do I want to go back?? I honestly think it would be easier if he moves to my country but he has a son so that's not an option... just want to be with him... thanks.
