For those of you with children I have a question. Is a court order enough to bring for your interview that shows you have the permission of the other parent to move your child(ren). This only applies to those that have another parent actively or somewhat involved.

In my case I will have a court order stating that he consents to me moving and enrolling the children in the USA etc. Do I still need something from him sworn that he consents?

I would say that is enough proof Karen. I mean it is signed from the judge stating your allowd to move with the kids.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

My court order was good enough. That was a document they wanted to see with the official seal on it. Also, at my interview they told my daughter and my husband to leave and she asked me about the order and some other silly questions about it.

Feb. 15/ 07 --- GC approved

Nov. 17/09 -- I-751 sent (Day 1)

Oh my goodness ... Is the divorce order stating full custody as well as no restrictions on location of childs permanent residence enough? or is a letter from the childs other parent a definite requirement? :o

Met in Cleveland 07/07/05 ... Fireworks!!!

Emails and phone calls until first visit back September '05

Many trips to Cleveland and overnight stays in New York

07/18/07 - Interview yeeehaaa .. approved

07/26/07 - received Visa from Montreal (should have received 07/24)

07/26/07 - POE Buffalo, NY (Peace Bridge) .. No EAD stamp

07/27/07 - Beautiful marriage .. now you may call me Mrs. :)

07/28/07 - Filed AOS,EAD, and AP for me and AOS and AP for my son via UPS .. received 08/01

08/16/07 - applied for ssn

09/03/07 - received ssn card

11/07/07 - AP approved and received 11/12/07 :)

11/19/07- EAD approved online and received same day (actual approval 11/07/07) :)

12/27/07 - AOS transferred to CSC

02/26/08 - 485's approved without interview

01/14/09 - Sent I-751 - removal of conditions

02/23/10 - Biometrics

03/17/10 - Removal of conditions approved .. card production ordered

I would think you are just fine with your order. Especially since it states you have full custody and no restriction on location of the childs permanent residence. :thumbs:

I would think you are just fine with your order. Especially since it states you have full custody and no restriction on location of the childs permanent residence. :thumbs:

My order says we have joint custody. But it lists a zillion different parts that pertain to my being allowed to do anything I want with regards to residence, school, I have all final decisions etc.

Really it comes down to having it so detailed that I have sole custody but it says joint if that makes any sense.

Those of you that have moved your K2 children did your order say sole or joint or what?

I have sole custody...but even with that I still HAD to get permission to move the kids. I think my lawyer told me permission had to be obtained even if you were moving more than 30 something kilometres away, maybe it's more. USCIS is not so much interested in what your custodial arrangements are so much as you need to prove you aren't kidnapping them..IMO.

Hmmm well then maybe I need to him sign something else? The court order says I can move them. The court order stems from "minutes of settlement" that him and I batted back and forth. We have had it formalized into a court order. So I wonder if his signature on my copy of the "minutes of settlement" is enough? Or if I should have him sign something else? If so, what?

Thoughts?

I have sole custody. My orders stated supervised visitation with my oldest and no visitation with my younger ones. I also had an order of release (from jail) dated about 10 yrs ago that stated he was not to have contact with us. I did not get permission or even tell him we were leaving (did not even know his location at this time as we have not seen him in over 10 yrs).

I took those documents to Vancouver, told the guy we have not had contact in over 10 yrs and he has never had visitation with any of the kids. He apologized to me for making me go through telling him about it.

That was it, we were approved.

*January 24 2006 - mailed in I129-F petition

*January 25 2006 - I129-F received at CSC

*January 30 2006 - packet returned.....arggggggggg we forgot one signature!!

*January 31 2006 - sent I129-F back to the CSC, hope we did not forget anything else

*February 1 2006 - I129-F received at CSC again

*February 3 2006 - NOA1

*April 20 2006 - NOA2!!!!!

*April 24 2006 - Touched!

*May 15 2006 - NVC received petition today!

*May 17 2006 - Case left NVC today!!

*May 30 2006 - Received Packet 3 from Vancouver!

I think my order should be ok. It is most current. Dated this past week in fact. It lays out provisions for everything from the move, to their permanent residence applications, schooling, and even passport renewal when the time comes.

I think it should be ok.
