Hello,

If a spouse wants to apply for fiance visa but the beneficiary had a "false claim of citizenship" (through 1-9 employment form and house loan application) would it safer not to apply or just apply and come clean. I understand they dont give any waivers for false claim of citizenship but a lawyer states INS can "forgive". Anyone has any experience with this?

Any help is much appreciated.

if it is spouse you cannot apply for fiance visa, you have to apply for cr1 spouse visa. And a false claim to citizenship carries a lifetime ban. I have seen few here who have attempted to to get around it and have never been successful. You need to think about living in the spouses home country, or a third country.

You wrote spouse, you cannot apply for K-1 if you are already married. A lawyer is going to be very expensive due to this situation. I have not had experience in this, you can go to GlobeHopperMama page on VJ and read their story. According to her story, false claim of citizenship carries a lifetime ban with no waiver.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

To grant a waiver is to "forgive."

As others have said, a false claim of citizenship carries a lifetime ban. It appears that lawyer only wants to take your money for a service that is impossible to receive.

Can you live in your spouse's country, instead?
