Hello. I want to file a petition for my Mom (Philippines) by December but my husband and I will leave the US by September to Germany for work related issues and doesn't have plan on coming back until after 2 years or so. By September, (Maybe) my moms application will be approved and I can stay a little while with my mom doing her paperworks here in the US. My questions are:

1. Can she come with us soon after her paperworks are done?

2. Would she need to comeback to US before 6 months after she leave with us? for how long she needs to stay until she can leave US again?

I am totally lost right now. I know I need to do more reading but I do not know where to start. I am confused if USCIS will give her the 2 years or 10 years green card once her I-485 get approved. I do not know if I should just wait after 2 years before i file her petition or not. Please enlighten me.

Hello. If you will not be staying in the US for 2 years why will you petition for your mom now ? What will she do in the US by herself ? Anyway USCIS requires domicile of petitioner when the time comes that your mom will prepare documents before interview. It's better to petition her after you go back to US from Germany.

Your plan has many holes.

First, you need to be domiciled in the US in order for your mother to qualify for an immigration visa. Family based immigration is about reuniting families in the US. No need to issue a visa to your mother to come to the US if you are not living in the US.

Second, on what basis would your mother be allowed to live in Germany. A US green card does not give her any benefits in Germany.

All of this. If you want her to live with you in Germany you should look into a visa there and just file for the green card when you return. A Filipino citizen, even with a green card, can't just up and move to Germany.
