How much income needs to be shown on the tax return during affidavit of support process?

$20,000?, $30,000?

more?

I know its gotta be like 100% or 115% above the poverty level, right? I'm not really sure what that # is. Any help here? I live in the USA. Thanks for any help.

Current income has to be 125% above the poverty level.

Thanks for the replies everyone. I followed the link. I have no dependents. I was actually claimed as a dependent by my mother because I didn't file my taxes for a few years. I am ready to file my back taxes.

For 2009 I only have: $1,166 (I spent most of the time going to different doctor's appointments while in the U.S., and for the rest of the year I was in Japan)

For 2010 I only had: $9,271

For 2011 I had: $23,328

Its too early to file for 2012 (I have my check stubs though), but I will have more than I did for 2011.

Is it looking pretty bad for me and my case?

I may have 1-2 reliable co-sponsors, but I was hoping that it didn't hve to come to that.

I don't think you're required to file a return for 2009. However, you ARE required to file a return for 2010 and 2011. Your mom already got the exemption.

The consulate won't accept your affidavit of support if you were required to file a tax return and didn't file, even if you've got a joint sponsor.

My current salary does meet the requirements (125% above the poverty line). For the affidavit, I will be sending in proof of work, etc. I will also be sending in my W2s from the past three years. Where I was a student, I was earning lower than the poverty line (working part-time jobs). Would that pose a problem for my fiance and I, when he goes for his visa appointment?

Yes, that is what he is saying. File the back taxes for 2010 and 2011. You only need to show the most recent tax return for the affidavit of support plus evidence of current income such as a letter from employer and most recent pay stubs.

You can then most likely file for AOS after you have filed your 2012 taxes in a few months, and will only need to list your 2010, 2011, and 2012 taxes on the I-864 then.

They generally go by current gross income. There are a very few consulates that use the tax return to determine eligibility but not many. The tax return is basically a reference but it is not necessary to meet THIS years requirements with LAST years income.

Attach a tax return AND proof of current income such as employer letter, recent check stubs etc.

You need ONE year's tax return for the interview (most recent year) ad a statement of gross income claimed for the last three years for the AOS. Unless specifically requested you are NEVER required to provide three years tax returns.

The only time I did this was for the naturlaization process to prove that my wife had filed taxes as required by law for permanent residents, it was not to verify income but to show she had met her obligation as an LPR

it actually doesnt go by past it goes by current...if last year you made a million but today your unemployed its a problem thats why the letter from employer of current earnings and future earnings is most important......(so tells me my lawyer)

They're only looking at the current income by providing the Employment Verification Letter. Previous years 1040 or tax transcripts are just supplemental.

If your salary currently doesn't meet the guidelines you have to have a co-sponsor. You still have to provide your financial information but your co-sponsor will have to show the same.
