Filling I-130 again and abroad

Hello guys!

I´m the beneficiary and I´m living in Spain with my wife and kids and actually we´re filling my I-130 for the 2nd time. We did our first case with the support of an administrative company, and wait about 10 months to ultimately get denied for some dumb mistake (missing documents of an RFE). Researching and researching we found out that the case was managed extremely poorly by this admin. company, so we are now here with our lesson learnt, almost ready to send the I-130 again.Here´s the topic of our first case

I would appreciate if you guys answer a few questions I have and also some wise tips about the package I´m about to send. Here we go:

-Payment

-Cover sheet

- ???

-Form I-130

-Birth Abroad Certificate (petitioner)

-Passport (petitioner)

-USA marriage certificate

-G325A (petitioner)

-Passport picture (petitioner)

-G325A (beneficiary)

-Passport picture (beneficiary)

---Bonafide

-- Our son´s US birth certificate

-- My wife´s spanish ID that show´s she´s my dependant(as a foreigner in Spain)

-- 1st page of our spanish tax declaration (show´s both names and it is signed too)

-- Padrón. This is a police document that shows that we both are living in the same address

-- Around 40 pictures that covers around 2 years of life together in Spain.

What do you think guys, does it look complete?

Questions

- I heard that USC living overseas are getting their cases auto-expedited, after the August 2011 changes. Where should I put and remark that the petitioner is living abroad? In the cover sheet? Should I attach an explanatory case sheet?

- Should I place an explanatory letter about our denial and attach the denial form?

- I heard about the USCIS translations requirments, can I put myself as the translator? I also read that in the consulate interview they ask for certified translated copies, so I´m kind of confused about this matter.

- My wife was born in Iceland, but in a US militar land (her father was in the Navy.) She has a Birth Abroad Certificate that looks pretty much like this one. I´m not sure about what to answer in the 13th I-130 question, I understand Born in US... any tips on this?

Your list looks sufficient, all you need are photocopies of the above items.

Answers:

1. On forms that ask for the petitioner's address, use the address in Spain.

2. There is a section on the I-130 that asks if the person has filed a petition on behalf of anyone before and if so, what the result was. This is where the previous denial will need to be explained.

3. Others have said that they signed the attestation statements themselves and have had no problems. My view is this, have a third party who is fluent in the language sign the attestation statement. That is only my opinion, others no doubt will have their own two cents on this matter.

4. Hopefully someone else will know the answer to your last question.

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Thanks Ryan for your helpful answer, I already sent the package yesterday. Hopefully we get expedited since we both ate living abroad.

I also wanna thank the VJ community for been so helpful, all the info contained here cannot be valued, it is priceless!

Hello guys, I just wanted to update that in January 2 I got approved! My case is now transferred to the NVC from the MSC, I´ll be bothering you with a bunch of questions so my children, wife and I can finally go back to the U.S.
