Normally they estimate 5 months. A year ago VSC was about 3 1/2 months and CSC was 5 months. They speed up and slow down all the tim, sometimes they stop for a few weeks, or at least it seems so. The 5 months is an estimate to review the petition. RFE's can add time. After the petition is accepted (the 5 month estimate) there is still the NVC, then the medical, embassy interview, receipt of the visa, and scheduling the flight.

I would never expect 5 months start to finish. Not saying it can't happen, but in the vast majority of cases 5 months start to finish is not reality. Sorry to say, but the December/January timeframe is just to get the next Notice of Action (NOA2), not the completion of the process. I don't know how long the following steps take in India, but for the Philippines (where you can move the process along very quickly) it takes nearly 2 months for those following steps if you really push it.

Once you marry, even if you do it the first day, you need to wait for the marriage certificate then apply for AOS/EAD and receive that, potentially 3 months or longer, before you can work. Best case might be December for the visa but likely March or longer before you can work. That's best case. If there are RFEs or other delays, or delays in India, issues with AOS, you could easily be to next June or even later before you can work in the US after coming on a K-1 visa.

Not trying to bring you down, just presenting the reality to help in expectation adjustment.

Good luck!

Hey there Dude...be patience. I talked to a Rep from Vermont and the information that I was given is that their possessing the month of March. I filed in April an I'm pulling my hair out. We're just unfortunate that we have to deal with the east coast. California isn't having these problems.

Oh thats a long time...really this waiting time really sucks. And i miss my fiancee all the time. She wants to come over and meet me but we are not doing it because we were expecting them to give us a visa in 5 months and were planning things accordingly..Now Vermont gives us a shocker .... We had planned for my work status after filing for AOS once we got married in Dec...Now things will be delayed even more...

Don't ever "expect" anything in this process, The 5 months you speak of is just for the USCIS stage, that does not include the NVC or consulate stages. There is nothing anyone here, at a senator's office an attorney or the little green man on the moon can do to expedite your case. There are too many variables to predict when or if anyone will be approved. My suggestion is to just try to keep yourself as busy as you can until the time comes when the visa is actually issued. I speak from experience as my husband's visa was delayed in administrative processing(AP) at the consulate level. It took 10 weeks of AP after hisinterview before his visa was issued. He just received his visa in hand today, his interview was in July. Good luck!!

Its taking us forever for all this and we were planning a wedding for us in december. I can not even ask my fiancee to come over to meet me because we will be short of funds at a later stage. Also i have been assured a job transfer to the city where my fiancee lives however if my company finds another person to fill up that position before me i am screwed.. I really dont know whats happening with vermont service center.. Does writing to the local senator will help us..It has been a long patient wait for 5 months (right now its 4) but a lot of things have been planned by us considering the 5 month mark..Now they dont seem to be doing all that really quick.... :(:crying:

Welcome! Join the club. Some April filers have been approved. I am one still waiting. If you notice in my signature, I am moving on toward 6 months. There is nothing to do but wait. I might be able to get a service request by 6.5 months. Writing a representative could or could not help. It depends on what VSC is considering "within normal processing times". We all have/had plans. Your plans do not matter to them and will be on hold at their will. Relax, stay strong, and plan accordingly when the time comes.

Yeah it is just unfortunate that we are on Vermont service center right now. I checked the stats and currently California is processing July applications while as per VJ VSC is doing March 28 2012...I did saw some application from 12 April 2012 approved in the timelines so wonder whats gonna happen. My timeline says it would be 12 dec 2012-18 dec 2012 for NOA2 which sounds like a distant place..Its really hard for people to stay without their partners and i can already what other senior members must have felt by now..i really hate this patience because just till last friday the VSC processing dates were 5 months and now they show it 6 months officially....Who knows what they have in store for us... :crying::unsure:

Thanks a lot..I think i need such wishes :innocent:

Hi,

I recieved NOA1 on April 10, 2012, and I am still waiting for NOA2. Now I am thinking, I should have applied for my fiance back in January, 2012, because my engagement was back in December 2011. If I knew, VSC was slow, I would have done it in January itself  . But I did take a quick vacation and met him in August :) . So, hang in there, and try to move your wedding plans to January or something. I know it is tough to do, but with VSC processing times, we cannot plan ahead. Even I was planning to get married during the Thanksgiving break, because, that week am off from my grad school, and I can take vacation easily from work. But now I changed all that.

Yeah thats what i regret now. We did not got married before because we thought it would be quicker to be together with the K1 visa and thats why we postponed our marriage. Now sometimes i feel we should have done it before with so many complications coming in this K1 step. I hope god and VSC has a little mercy and dont delay it further...
