Line 22 on the 2011 tax return is the current income for a self-employed person. "Operating loss" means self employed. Unless the business is closed and the sponsor now has a "job" with employment income, or some very significant liquid assets, a joint sponsor will be needed.

I talked to my husband and the operating loss was incurred years ago...yes he read the instructions.

The company where he worked before didn't pay him right and so he have loss,and I told him dat "opearting loss" should be for self-employed person and he said that's how IRS did it when his CPA filed...Actually he have some refunds from IRS around 10,000 dollars and its on process now.

I'm sure his taxes are properly prepared but the consequence of an operating loss shows a negative income. If he is NOW employed with a good employment income and is no longer self-employed, then he may qualify. The issue is going to be how he states and documents his current income.

Facts are cheap...knowing how to use them is precious...

fiancee is self employed but his total gross income was 40k earn yearly shown his 1099 but i was also confuse if we need a co sponsor because his 1040 line 22 was only 15k maybe a lot of deduction from schedule c attachment..

so do we need a co sponsor even he earned yearly 40k? but his total income line 22 was 15k a lot here says the co looks to line 22 for self employed are we going to look for a co sponsor?

Don't confuse gross revenue with income. Income is from line 22 AFTER deducting expenses from gross revenue. Sounds like you need a joint sponsor, unless there are significant liquid assets that can be declared and documented.
