How can I expedite? They made a mistake

I called the USCIS number two weeks ago and they told me that my case had been cancelled, but the formal letter had not yet been sent. I caught them just in time. THey sent me the IMBRA RFE in June, but it got lost in the mail. When I called to have it resent, they only sent me a letter saying that it would be resent, and they never re-sent the RFE. However, my case nearly got cancelled because they never got the RFE (that I never received). Iit is pretty obvious that they made a mistake and somehow my name got lost in the system. Anyways, I called many time last week and convinced them to reopen my case and they sent me the IMBRA RFE last week. I turned in my petition in June. I know that you can request a case to be expedited if the service center made a mistake, which clearly they did. How do I go about expediting my case? Is there a form I need to fill out? I can´t figure out what it is if it does exist. I am sure that someone out there knows the answer to my question!!! Thankyou!!!

2/20/2007--K-1 interview and approved visa!!!

3/14/2007--entry into the U.S

3/19/2007- civil wedding

3/21/2007--OAS papers mailed off

4/21/07 Biometrics appointment

6/20/2007--AOS interview in sacramento--almost aproved

General Expedite Procedures:

A detailed explanation of the situation should be provided in a one-page support letter prepared and signed by the petitioner or the applicant. An expedite request can be submitted by mail or fax. When mailing, mark the envelope with a red dot and send the request via bonded courier or other overnight delivery service to:

Cases will not be expedited if they are not clearly approvable. Requests to expedite petitions or applications that are incomplete will not be granted. All supporting documents not in English must include a certified translation. See Documents Not in English" section. Please see our USCIS Expedited Criteria guidance. There is no appeal of the denial of an expedite request.

USCIS Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Service Center Director. The criteria are as follows:

  • Severe financial loss to company or individual.
  • Extreme emergent situation.
  • Humanitarian situation.
  • Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States.
  • Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government.)
  • USCIS error.
  • Compelling interest of USCIS.

If a response to the expedite request is not received within 72 hours, the request is denied. The application or petition will then undergo normal processing.

Note: they mention Fax but I was unable to locate a Fax number on the website, you may just call them for that number.

Vamila, you might also want to ask for your senator's assistance - CSC doesn't often expedite cases (even when it's their error) so you may need some help. Good luck.

Can you imagine what the backlog would be like if they had to chage the status to 'expedited' on every case they made a mistake on? :blink::lol:

(seriously, at this point, they have been moving so quick once they receive the RFE's you might actually delay your case by trying to get it expedited)

The abrasive Andy Misu made it work, even after so many posters told him not to even try as it's useless. but it worked for him.

So I wish the OP best of luck in trying. I also tend to think it'll be useless, but then Andy's success makes me keep my mouth shut and wish people who want to try best wishes.

Well at the risk of starting a new, big fight - in the end it was debatable if (the abrasive) Andy actually got his case expedited since his approval came a few days before the service center's response. Even if he truly did do it, he was dealing with Vermont which is a whole different world. We've seen cases were CSC mistakenly sent cases to a black hole in El Paso for months on end and even when the petitioner's Senator contacted CSC and tried to get the case expedited due to what was very clearly their error, CSC refused. So it seems pretty darn unlikely but worth a shot with a Senator's help.
