I am finishing a cover letter for my ROC waiver form... does anyone have any examples?

My divorce won't be finalized until the end of the year, but I have to file now. Do I need to mention it in the cover letter? How?

Instructions say I need to submit stuff explaining the end of the marriage.

- I have a letter from my lawyer initiating a divorce, then his lawyer response delaying this divorce, and finally a letter to appear in court in November for a pre-hearing. Do I need to submit that?

- How about copies of the police reports? Once I called because I told him I'm done and ex got suicidal, then he called when I was moving out because he didn't want to let me into his room to get my stuff, and once I filed for emotional abuse and rape and animal cruelty, but the case was closed due to a lack of evidence. However, in this last report he does admit that he was doing several bad things to me.

- I also have a transcript of my individual counseling in regards of my marriage falling apart. Need that?

At first I thought to save the reports and a transcript for an interview, shall there be one, but then read about the explanation of the circumstances in which marriage ended... and I don't know again.

I have a copy of bank statements for joint accounts, in 2 of them the bank literally cut out pieces to remove info about my ex's new individual bank account. I explained it in the cover letter, but did I have to?

thanks!

I'm not sure about where in the instructions you claim it asks to show "stuff explaining the end of the marriage". It asks for the divorce decree, but that's about it.

You simply need to write in the letter that you are asking for a waiver of the joint filing requirement due to divorce and that you're enclosing evidence of your bonafide marriage. You can submit a copy of the initial divorce petition if you want but it doesn't mean anything. You need bank statements, and bills and stuff like that.

You are asking for a waiver based on divorce, not on abuse. Sending in the info about abuse might confuse them into thinking you're filing on those grounds. then you might end up with an RFE requesting more evidence of abuse.

Page 2, Evidence of the relationship, middle of the first paragraph:

"Submit copies of as many documents as you wish to establish this fact and demonstrate the circumstances of the relationship from the date of the marriage to the present date, and to demonstrate any circumstances surrounding the end of the relationship, if it has ended."

Relationship ended because my husband was controlling jealous freak. I tried to work it out during therapy, but only realized that it's not normal husband and wife relationship. I think I might add to my cover letter that it has started around Christmas, 6 months after the wedding, and no, I have no idea how I didn't notice this before.

I am also submitting one of the older car insurances with my name on it as an extra proof that we were indeed dating before.

I don't have a divorce decree yet, submitting initial petition... along with 40-something pages of taxes, credit cards, leases, bills, insurances and other stuff.
