Marry him or file K1 visa?

HI! i just want to ask regarding my friends situation. My friend is a US citizen,and married her boyfriend in the Phils. But before they got married my friend went to US embassy Manila and tell them that shes going to marry her boyfriend. So after getting married she petitioned her husband and came here in the US.and after 3 years they divorced.

Now,my frien met another guy way back in the Phils. They love each other and want him to get him here in the US. What should my friend do?Since there is no divorced in the Phils. can she marry her new boyfriend in the US embassy Manila?what are other options for her to get her bf here.

she can file for k1 fiancee visa for her boyfriend so they can get married in the US.

if they want to get married in the Phillippines, she should file an annulment for her first marriage.

how about if she was not yet a US citizen from the time that the first marriage was perform but they got divorced here in the US when he got him here?

Can she still get married with her bf now in the Phils. even if they did not file for annulment?

At first, your story makes it sound like your friend was a U.S. citizen who went to the Embassy to get an affidavit in order to get married in the Philippines, then got married in the Philippines, and then petitioned her husband using a spousal petition.

Now it seems as if you are saying your friend was not a U.S. citizen when she got married in the Philippines. How could your friend have petitioned her husband if your friend was not a U.S. citizen?

Now it seems as if you are saying your friend was not a U.S. citizen when she got married in the Philippines. How could your friend have petitioned her husband if your friend was not a U.S. citizen?

LPRs can petition spouses (with a wait) as well. I'm not sure if that is what the OP is saying happened, it's pretty confusing. OP, is she a citizen or not & how did she obtain her citizenship?

10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

11.02.2012 - Mailed I-751 packet to VSC
11.08.2012 - Checks cashed
11.10.2012 - NOA1 received, dated 11.06.2012
11.17.2012 - Biometrics letter received for 12.05.2012
11.23.2012 - Successful early biometrics walk-in

05.03.2013 - Approved! Card production ordered!

CITIZENSHIP
