I now know that my fiance got denied at the interview stage by checking the status of the case online. He is not home yet so I cannot say what happened. We will now of to see what can be done...

Goodluck to everyone who haven't had interview yet. I truly hope that you will have better luck than me and my fiance did. This site was very helpful. I learned a lot and used this site to do everything I was supposed to so this is quite unfortunate....

You have got to be kidding me? What does it say on the status page to indicate denial?

I only see REFUSED. Below that it says to refer to the letter that was given during interview. i am really not feeling welll right now especially since I can't be with him but I figured it's best to write about it and well... At least others will read this and know that they of to be careful with their preparations.

My fiance still haven't made it home. I have been communicating with his family but they are not sure where he is. I just hope he's ok. I don't even know how to feel right now but I do know that I feel like the officers do not care about love or uniting loved one...

I of to wait to hear from my fiance. Until then I won't know what letter or paper they gave him and what happened during the interview.

Yeah...it's not yet clear what is going on. I'm hoping that it is actually "PENDING"...and that they simply need more information. Or maybe a 2nd interview will be scheduled? I hope this is not something you have to appeal to resolve in your favor.

Thank you. I didn't quite understand when he was explaining so I asked him to scan and email the paper to me so I can get a better understanding. I'm pretty sure he needs a waiver ( possibly for something I explained to you awhile back). Does that mean I'd of to appeal? I really wanted this to be over with but I will try to be positive and do what they asked.

He will get the paper to me sometime soon.

This is a bit over my head, but it does not sound like an appeal is needed. An appeal would be needed whan a final decision has been made. If they are saying he needs some sort of waiver...it seems that they would reconsider the visa application after a waiver has been produced.

Again...this is over my head as I am not exactly sure what the waiver if for...or where you get it...etc. In my own case...I requested a waiver of certain IMBRA requirements...but this was for a very different kind of waiver. Also...I did not produce a waiver...I requested a waiver from USCIS. I could speculate on the kind of waiver they may be seeking...but I think this will be clear in the document they give you.

You may need an extension of your petition validity to deal with all of this. I am so sorry you are having to face this...and I'm hoping there is a quick fix to the problem.

I received the documents from him today. They circled some stuff that I need or needed to send and didn't for affidavit of support. They also said on another sheet of paper that he is eligible for a waiver but did not say which one. I am guessing it's I-601 but the embassy did not provide explanation for their decision. They told him to refer to the papers he received but then the papers did not give explanation. I feel like I have done my best with this application so now I am discussing with my family to see whether I should continue with this process or just head to Jamaica to marry my fiancé. I cannot deal with being apart for another year or two (maybe more) to get I-130 approved so I'm not sure. Looks like it's time to consult with a lawyer as I cannot afford to have immigration officers play around with my life...

At least they did not try to say my fiancé and I do not have a bona fide relationship. That would be insane...

Understand that some of the issues you face for a K-1 visa may resurface for a K-3 visa. So...getting married may not make things as straightforward as one may think.

If you write to the Embassy..they will likely explain more about the kind of waiver required here...but it may be the kind of thing in which if you have to "ask"...a lawyer should probably be doing it anyway. As for Affidavit of Support...I know a lot on this one...so feel free to send a private message if necessary.
