Thank you Winelight!

You were right again. I certainly hope with all my heart that you are right about the interview also because if not that would just be completely devastating. Anyway I will let you know the outcome like I said in secret7vf.gif

Take care also. You truly acted as a friend. I wonder if the immigration specialist at my congressman's office had anything to do with it... I have no idea but I'm still glad I took your advice on that.

God bless you too friend.

Thanks Dee&Tino. It is easy to act as a friend when others have done so for me. I am certain your interview will go well. You already know what you must do in your case...and how to be proactive with information that makes your case clear. I look forward to hearing positive news of your interview results in a couple of months...or so. I will let you know what happens with me too!

Again...God bless you my friend.

Ok thank you because I do want to hear about your interview approval as well. Do you have an interview date yet? I was a bit confused when I read about priority date and cutoff as far as NVC issuing a case number but I didn't receive my NOA2 in the mail yet. I also need to look into what the visa fee is and who gets this payment. I think I may've slacked on knowing the NVC process. Anyway, I look forward to our online celebration in a couple of months. With God all things are possible and that's why one should never give up on their goals or dreams...

Thank you winelight and Dee and tino!!!

You're welcome

No interview date yet...or NVC case number. In fact...I don't yet have my hard-copy NOA2, which they claim was mailed over a week ago. I cannot even confirm that NVC has my case at all...or that it has been sent to NVC by USCIS. I have heard stories that the regional USCIS processing center does not always send approved petitions to NVC immediately...so...this is also a cause for possible delay.

I'm not an expert on what happens at NVC, but NVC is more focused on immigrant visa, and not non-immigrant visas (such as K-1). As such...NVC controls the appointment process for immigrant visas, but the non-immigrant K-1 visa passes through NVC to receive a case number prior to NVC forwarding to the appropriate Embassy. With immigrant visas...there is sometimes a priority date for specific visa types...which is enforced by NVC. So...approved immigrant petitions will have to wait in line until their priority date is "called". If the petition date is at or beyond the cutoff date for that visa type...NVC will then move forward toward an appointment for a visa interview.

K-1 fiancee visas have no quota or limits...and therefore no priority/cutoff date (or maybe there is a priority date that is adjusted to the current date each day???). Either way you look at it...it is ALWAYS your date...and always your turn. This is why NVC passes all K-1's on to the appropriate Embassy for visa processing without conditions.

As for payment of the visa fee...the Embassy instruction packet will explain this as it can be very different for each country. Sometimes payment is made at a bank or post office in the foreign country...and the receipt of payment is then presented to the Embassy.

I hope I got all of this information correct...but I would appreciate anyone that will correct any misunderstanding I may have here.

Yes...I also look forward to an online celebration with you in a few months (for some...the NOA2-to-interview process was less than one month!!!). I will certainly update you on my interview at that time.

Many regards...

For all of you waiting for NVC to receive your approved petition...

I just spoke with NVC by phone. My petition was approved May 28th, but they have not yet received the petition from USCIS. I was told that it usually takes 15 days for NVC to receive the approved petition...and that I can contact them again after 15 days for my case number. They also confirmed that they do nothing with K-1 petitions...other than assign a case number and forward to the appropriate Embassy for visa processing.

Did the Tier 2 enter a Service Request? Sounds like you have waited long enough to be entitled to special treatment at this point.

She didnt let us. She told us, that they have 60 days to respond to the RFE, so we have until 17th if June. It is so frustrating already, and it's just a simple RFE

Thank you for clarifying that for me. I understand better now. I'm sorry to hear that you are still waiting for case number but i'm sure you'll get one soon (next week). Anyway, i'll certainly keep intouch... I've been so busy and tired that i actually don't mind waiting the 15 days before i of to get that number and get the ball rolling...
