You are not alone, my NOA 1 is October 23 and still waiting, I thought I was the only one waiting since I didnt hear anybody complaining, I am loosing hope !

Thanks for your response. It's not good that we are still waiting but at least you know now that you are not alone. Goodluck with your case and I hope we will both get our NOA2 soon :-)

Don't loose hope guys, i was about to quit the process...i felt drained, my fiance and i were both depressed and exhausted with the waiting and the tension this whole process had created....but when i least expected it came....there it was, my approval came on May 24th, just a day shy from the 7 months mark...so dont lose the faith, contact your congressman, senators, God and whoever you have to, pray and hang in there because your day will soon be here too.

Hi. 10/03/12 VSC Noa1 here, received an rfe on 04/09/13 they received my reply on 04/17/13. Until now, no signs of NOA2. Am I the only one? :(

Hi Madison,

Did you call USCIS? It's actually a good thing that you got your rfe already though. I think you'll get your NOA2 soon so just hang in there with the rest of us

They also told my fiancé that we should wait for another 30 days for an approval or denial. Might as well give it a try too. I have to push my fiancé to call the uscis.

I just got a message from USCIS that my petition is approved...and NOA2 is in the mail. I'm numb from waiting so long (229 days since NOA1) that I don't even know what to do...or how to celebrate. Well...I expect my smile will get bigger and bigger each day now. I think I will go out for dessert tonight :-).

NOA1 was Oct 11...and no RFE. It just took a very long time. I did an e-Request last week...and had my Congressman call CSC. Not sure if this made a difference or not. If you have anything complicated about your case (I had to submit an IMBRA waiver), don't be surprised if your case takes several weeks longer to adjudicate.

All the best to the remaining CSC and VSC filers (Am I the last CSC filer in this thread...with the exception of RFE's?).

I see people suggesting that I contact congressman but i'm not even sure how to do that... Not even know who mine is b/c i'm not too good with that stuff

IMBRA laws will not allow the approval of a fiancée petition under certain conditions...unless you ask for and receive a waiver from IMBRA restrictions. If you have filed 2 petitions with the last 2 years...or had an approved petition within the last 2 years (as I recall the law), you have to be granted a waiver by USCIS before they will approve the current petition.

As for contacting your Congressman, find your Congressman first (http://www.house.gov/representatives/find/) and call them. Ask for the person that handles immigration matters...and they will assist you.

Complicated cases can require more documentation. It seems that USCIS does not always believe something is true unless there is a document to prove it. IMBRA is a bit tricky because you have to provide a "reason" to be granted a waiver...yet they are not clear on what reasons will be acceptable. It appears to be a judgment call made by USCIS. I suspect that complicated cases will process more quickly if the petition package is well-organized and there is plenty of documentation to support claims, or, make certain matters more clear.

The best to you for a rapid approval.

Good to see you back on here Brandon and Sugar! Sorry about your RFE situation but something seems to be wrong and you gotta get on top of things. Did you call?

We did, a couple of times actually but each time my fiance would call, the person on the other line would say they don't have anything to say then would hung up, LOL @ that! At least I'm not the only person having such luck. Hang in there friends, we will eventually get our approval soon.

Thank you for the information Winelight. I will certainly look into finding my congressman and going from there. I understand the IMBRA waiver now. I tried my best to organize my fiance petition very well. I haven't received RFE and at this point I don't want one so yes i do hope to get that rapid approval. If I were you i'd definitely go celebrate

Oh ok. I think it's great that you can still smile or laugh and not let their response to your fiance bother you too much. Shows patience

Not sure if this applies to Dee&Tino or others...but I'd guess your expected processing time has already passed? As such, you can make an e-Request on the USCIS site to look into the delay. I did this...and was approved a week later. Not sure if the e-Request made a difference, or what, but it is worth a try and very quick and easy to do. And unless I'm mistaken...I think you can make an e-Request after 30 days of waiting for approval of an RFE submission (someone correct me if I got this wrong on the RFE).

Again..the best to all of you that are "hanging in the balance" for months. I understand what you are going through as this was me a few days ago - until I got my NOA2 (7 months and 17 days after NOA1).

P.S. - And yes...I DID celebrate with apple pie and ice cream the night I got the good news!

Aww....I'm glad i was able to give you a little bit of hope.

I am always going to be checking on you guys, it's crazy how we get so involve with others situation when we are going through the same!...at least me anyways.

Winelight your information is very helpful. Yes my petition for my fiance is definitely pass expected processing time. I called yesterday and they told me that they cannot do or tell me anything since I made request ticket on May 14th which they responded to with email and letter. I believe one response said to wait 30 days before contacting them again while the other said to wait 60 days. Waiting 60 days means waiting until July which is very hard at this point but I am going to try doing another request on the USCIS website like you suggested. I tried once before but it wouldn't let me... Said that my petition was not outside the normal processing time (it was).
