October 2012 K1 filers

I spoke to a Tier 2 rep at CSC today. I was immediately given the standard line that they are now processing July 2012. I had to step in and advise him that he does not have the most up-to-date info on what dates are being processed. I told him many petitions have been approved for Nov and Dec. (My NOA1 is Oct 11). Rather than ask to be processed immediately...I simply asked him for fairness. I told him that a "last come-first serve" process simply is not fair. The rep agreed with me - essentially agreeing that the July date is the standard pitch...and that the reality is as I had stated. He went on to explain that petitions can be sent to a lot of different places for processing...and because of this, and the time for various background checks, one cannot predict how long a given case will take. He directly implied that some early petitions will be processed late because of this. I argued that my case had not even been touched...and that any delay to my case is not related to background checks at all...or even who my case is assigned to. After checking, he again agreed...and simply said my petition is still waiting to be assigned to an officer.... again admitting it is not fair that others filing after me have already been processed. The only thing he could offer me at this point was that I do an eRequest on the uscis.gov site. I told the rep that I did not think my eRequest would be accepted until after 7.5 months (I am almost 7 months now). So...after the call with rep...I tried an eRequest based on his advice. Sure enough...the USCIS site automatically blocked my eRequest with a message that I am still within normal time limits - and cannot make an eRequest.

With a Congressman that was completely useless in this regard (Mike Thompson - California's 5th Congressional District)...and an admitted unfair USCIS process for processing petitions...I have given up trying. I believe prayer can change things...but God does not promise when things will change. I just have to pray for the patience of Job to get through all of this.

A tier-2 rep can override the fact that a service request cannot be submitted because you're still in processing blah blah blah. I called and argued...the lady that helped me got her supervisors permission to do it. Give it a shot. Be adamant that it's not fair that others have been approved that filed after you. Tell them the sure says 5 months. Keep insisting. I did and it worked. I was told I'd get a response to the service request by the 11th. Hopefully the inquiry into my file will prompt it to be processed.

Another way is to go to an infopass appt at your local immigration office. I did that too and they also put in a service request for me. That's 2 service requests.

Both requests were put in within a 3 day period. One last Friday, the other Monday.

01-22-2016 - Check Cleared

I have some good news to share with you all October filers. NOA1 is October 15th, 2012. I got my NOA2 on April 24th, 2013. Then NVC received my case on May 1st and I received my NVC case number on the same day too. Today, May 3rd, NVC sent it to Vietnam. YAhoooooooooooooooooooooooooooooooooooo :))

Things are getting to me now. I was just in urgent care. Turns out the horrible pain I've been having...pain that wakes me up at night...is gastritis. All this stress...

@Mduenas, don't feel so down. Vermont is working on mid-late october files. You will get it any day soon.

Beside, there are many filers from California Service Center who got their NOA1 in July, August, September... are still waiting for NOA2. Back in few weeks before, the July/August filers from CSC have been moving from 200 days wait club to 300 days + wait club.There is also one February filer who just recently got their approval after 14 months of waiting!!! To sum it up, you are not alone, everyone feels your pain. Cheer up.

I made an e quest 2 days ago, but I don't think it can get me anywhere. My fiance said I should stop looking at vj and uscis to avoid further disappointment.

As of this point, all we can do is pray and pray harder.

I can feel you, this has been the most stressful 7 months of my life (including the preparation). It's not healthy for me and my baby that will be out this month. I've Been feeling bad for my fiancé for I know he's going too much hardship going here. What I'm just hoping is that we can get back with him on July. But it's still a long way for us. No possibility in sight. I feel like they're trying to annoy us for trying to expedite our case when we filed.

It's painful for me to say it, but better luck next week again. Fingers crossed.

Good luck to all of us still stucked in their storage room.

Hi fellow october filers. I am new here and started reading these posts a few days ago and I definately agree with all that the wait is frustrating. Howerver, I must say that reading your different expereiences and seeing that am not the only one who is waiting anxiously has been comforting. For those of you whose petitions have been approved,I am happy and jealous. For those who are still waiting like me,well...the wait continues. Here is a timeline of my journey so far

Oct 4th: date of NOA1

Apr 3rd: email RFE

Apr 5th: 2nd RFE email

Apr 10th: received hardcopy of RFE

Apr 15th: mailed back a response

Apr 19th: got email from uscis saying our response has been received

For the RFE,they wanted my fiance's passport photo(which I thought we already sent) and they said the evidence of our meeting was not properly established(we didn't write d dates and place on the back of the photos we sent earlier). Also,they needed our signed letters of intent to marry within 90days of my arrival in the US. After fuming for the entire day and wishing we had everything right d first time,we gathered all they requested and double checked before mailing our response. Now they say our wait could be as long as 60days! I sure hope it is way less than that. Oh! am a VSC filer too,so fingers crossed!

Well past the 7 month mark now - and have no clue what is the hold up - service requests are filed - i get the you will have a decison within 60 days :(

congressmans office contacted them and they said an expedite will be processed - I think no one is actually has any clue what is going on - they all just give the standard answers.

I'm sorry to hear of your troubles. When did the congressman say the expedite had been processed? That's good news at least? Hopefully that will mean your case is 'touched' really soon..

213 days :(

the congressmans office said that the USCIS agreed it was outside of the processing time and would ask for it to be expedited - yet when i called the next day and held for an hour for a tier two rep I was told it was within processing times and i would have a decision within 60 days...nobody gives you a straight aswer that is whats so fustrating. and its taking its toll on our relationship - I dont know how much longer I can do this....
