Hi, my Girlfriend and I have been together online for about 16 months now after meeting briefly back In May of 2011 when she was here in the U.S. on vacation visiting her family. She returned to the Philippines and not a day has gone by that we dont see each other on skype or yahoo messenger. We see each other when we wake, we eat meals together, talk all day & night and even go to sleep together while online with the lap top & tablet computers next to us. We have decided we want to get married. She has tried 3 times to get approved for another tourist visa & although she has never broken any rules & seems to meet all the requirements, they find every reason possible to decline her for another tourist visa. We need to know which way would result in the least amount of time apart from each other. I can travel there & we can get married, or I would still have to travel there just to get engaged, because we have no pictures or way to prove we know each other to qualify for the fiance visa. Does anyone know which of these would result in the 2 of us being apart the least amount of time? Thanks

Well, technical the K-1 right now because you can apply right now. If you wanted to do the CR-1 spouse visa, you or her would have to travel to be able to marry and then get the marriage certificate and THEN apply for the visa. So, really it sounds like you would like to be together again and not be apart for very long. If you want to get her to the US fastest, you should do the K1 since you can apply right now. After you submit the petition, you can go visit her and have more evidence for the interview if you would like. That would also break up the time apart for right now.

Getting married in the PI takes some time, but is doable on a 21 day to one month trip...the longer you stay the easier it will be to get everything done. In the end, does she want to work right away when getting to the US or can she wait another 4-6 months? If she wants to work right away, the spouse visa is the best. If you do the K1, you guys will have to get married and then file to adjust status. In the end you have to decide what is best though. Good Luck!

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

The Philippines is no longer on a Visa Waiver Program since 1981. It is the policy of our Government to automatically deny all tourist visas for Filipinos between the ages of 18 and 27 because they are a visa termination risk and will most likely not return to the Philippines. You would have to show extreme measures of her being tied to her country for her to be accepted for a tourist visa.

What do you mean by "ties to the Philippines?"

"Ties" are the aspects of one’s life that bind him/her to his/her place of residence, including family relationships, employment and possessions. In the case of younger applicants, who may not have had an opportunity to establish such ties, interviewing officers may look at educational status, grades, the situation of parents, and an applicant's long-range plans and prospects in the Philippines. As each person's situation is different, there is no set answer as to what constitutes adequate ties.

File for K1 visa. k1 is fastest compared to CR1, but you should show them proofs that you have a strong on going relationship. i suggest that you come here and see her for u to have more proofs like vacation pics, plane tix etc. (aside from those chat logs u have). Goodluck!
