Confused by instructions from Frankfurt!

Hi everyone,

We are in the midst of the IR-1 process and have just recieved the approval for our petition (otherwise known as NOA2). Everything I read on VJ says to send off all further documentation to the NVC in the US right away, whereas the Frankfurt website http://germany.usembassy.gov/visa/iv/apply/ instructs us to send all further documentation to the consulate in Frankfurt. What's correct here? I'm going to try to call the consulate tomorrow but in the mean time thought I'd vent my confusion here. Does anyone else know what these conflicting instructions mean? Any experience with this?

By the way, the NOA2 letter we received indicated nothing about our case being forwarded to the NVC in New Hampshire, AND it said in bold black letters that we should follow the instructions on the Frankfurt website very carefully or our visa process will be delayed.

Frankfurt does not do DCF, I already checked, so it's not because of that. This is kind of weird after all I've been reading on VJ. Is it possible that our entire case is going to be dealt with only in Frankfurt? Woohoo!

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

Thanks, Moomin, for the links! But I'm still a little confused. The embassy website only mentions the NVC in the case that the petitioner applied at the USCIS in the US and has numerical restrictions in their visa category, in which case it says that the case will be forwarded to the NVC. But I applied for my husband in Frankfurt and there are no numerical restrictions for us. I've copied their instructions below. The link you posted mentions the NVC, but if I can put it this way, only in passing. BTW, the Kartoffelsalat reference is for my husband...as you may know, everyone's mother here in Germany makes the best Kartoffelsalat in the world, and once we move to the US I'm gonna have to master his mom's recipe :-)

I guess I'm wondering, why would the embassy leave out SUCH a crucial point as the NVC? How the h___ would we successfully get the Greencard if we were using the official website for our case? How could it be so incorrect?

Here's what the website says regarding the next thing for us to do. In all further instructions, on the website for our situation (e.g. sending in police records and suc) ONLY Frankfurt, never the NVC, is mentioned:

Applied at USCIS Frankfurt <-- That's us!

If your petition was approved and your visa class has no numerical restrictions.

The biographic data form DS-23O Part I and II (pdf) should be completed for each person applying for a visa, regardless of age, and returned with a copy of the passport data page immediately to:

U.S. Consulate General

Immigrant Visa Section

Giessener Strasse 30

60435 Frankfurt

Failure to return the DS-230 Part I and II promptly will delay the processing of the application.

Applied at USCIS in the U.S. <-- Where the NVC first comes in

If your petition was approved and was either submitted to USCIS in the U.S. or to Frankfurt but your visa class has numerical limitations, then your case has been automatically forwarded to the National Visa Center (NVC).

Once the NVC has received your petition, you will be contacted per mail and asked to send in the following document:

DS-3032 (pdf)

The DS-3032 may be used by the visa applicant to choose an "agent" to assist him or her in his/her application and to receive mailings from the NVC. The "agent" may be the one who filed the immigrant visa petition, an attorney, friend or non-governmental or community-based organization. He or she cannot sign documents for the visa applicant but can assist with fee payments and document collection. If the DS-3032 is not returned within one year, the NVC will begin terminating the case.

When i applied in Frankfurt they handed me a broschure. This browchure states that you should not send in any documents to Frankfurt until requested to do so. This is contrary to what is stated on their website, but i believe is more accurate or up to date. The NOA2 approval should also inform you that the acomsukate in Frankfurt now ill be the coreect point of contact- when in doubt send them an email

We just filed in Frankfurt and I know that you should wait till your case is approved then you can send those documents:)
