Hi everyone~

I moved here to the USA from england on 22nd august this year after a long process of finally being able to marry my wonderful american fiance ( we got married on 22nd sept : ) and i am just filing my AOS I-485, my I-765 work authorisation and a I-131 to be able to travel back to England to see my eldest daughter who has remained in England ( my youngest daughter has moved here with me )

So just a couple of questions..

I am going to get my SSN next week from the local office, as a K-1 visa holder am i able to claim unemployment or get any income support while I am looking for work once i have got my EAD? I hope to get a job ASAP once i have permission as my wonderful husband is supporting us all at the moment, I just didnt know if i would be able to claim anything in the meantime to help while I am not working

Also, I plan to travel to England in about 6 weeks, having just filed all my forms is this a realistic time frame for me to receive my travel permit? I have written a good cover letter with it explaining that the travel is to see my daughter and for my other daughter who is here to see her father who also resides in England ( thank god..lol )

And one last thing, obviously i have a british passport with my maiden name on, do i need to change that before i travel or can i travel on my passport with my pre-married name?

I would really appreciate any help on this, my brain is about to explode with it all!!!

BUT having visited here many times over the last 3 years , I am so happy here and it has been worth every minute..hope all of you are finding your way to be happy : )

Most everywhere in the US I'm aware of, you need to have been formerly employed to collect unemployment (i.e. you don't qualify). It's an insurance program that you pay into while you work and you can only claim it if you've been working for a period of time (In Texas, it's three quarters). Are you going to be keeping your maiden name? If so, you don't need to change anything. Otherwise you'll want to make sure that your documents agree with each other. You want the name on your plane ticket to match the one on your passport, but you should be able to get an addendum in your passport easily enough.

12/7/2012: Service request replied to (but not delivered).
1/4/2013: Filed I-90, paid another $450
1/24/2013: Biometrics again...
4/1/2013: First Green Card from November finally arrived...

4/22/2013: Replacement Green Card arrived.

8/9/2014: Filed I-751

8/14/2014: Received NOA for I-751

3/12/2015: ROC Approved!

7/18/2016: Sent in N-400 to Texas lockbox

7/21/2016: N-400 delivered

don't forget to file the I130 too!!!

The I-130 is a Petition for Alien Relative. That's not necessary for someone adjusting status from a K1.

6 weeks is not enough time (a month and a half) . I filed fir my AoS on july 19 and I recieved my card 5 days ago. The EAD and the Advanced PArole are now in the same card (EAD/AP) combo card so you need to be approved in BOTH to recieved the card. Also if you file your AoS with your marriage name (like I did) you need to take your marriage certificate with you, cause your AP will have your new name. Trust me, i know how hard it is not been working but you are elegible for any kind of support, yet. You can not work either without at least with your EAD, at least, legally. I've been here for 5 month and its all about being very very patient

thanks for that, will the USCIS take any notice of the fact that when i moved here form england i booked a return flight as it was much cheaper and its very important that i see my daughter and that my other daughter is able to have contact with her father? do you think they might expedite it a little quicker? obviously i will not travel without the correct permit and i will just have to change my flights

I don't believe they will expedite it, no. I think you will have to change your travel dates.

thank you for all that information, im hoping that with my cover letter explaining the circumstances of my other daughter and maintaining contact between my daughter that lives with me and her father im hoping they might expedite it fairly quickly..just have to keep my fingers crossed i guess!

Now on the plus side, since unemployment is an insurance program and not a welfare type program, if you do get a job and later lose it, you can collect unemployment without causing problems regarding your spouse's I-864.

hi , no im not keeping my maiden name, i have taken my husbands name..so if i travel do i just have to have my marraige certificate with me?

The criteria for expedites are very, very hard to meet and even when they are met, they are rarely granted. I hope you somehow get approved very quickly, but you need a backup plan since the chances are, you will be waiting 2-3 months for your approval.
