Hi, I looked through some of the old comments made on 2009-2011 on Tourist Visa Extension Application. Is anybody applying it right now? I'm from Singapore.I've read that we need really good reasons to apply. What are some? I stated that I'm planning to spend time with relatives living in the states for Thanksgiving, spending more time with fiance who is working here, and continue touring around US with friends and family when they arrive later. I am so worried because I have yet to hear from them. I've submitted a support of affidavit form too, and sufficient funds for my stay. What are the possibilities? Please help :(

The possibilities are that your extention will be approved or denied.

Wanting to spend more time in the US is not typically a good reason

Tourist visa extensions are usually given for medical or family emergencies. You can stay in the US up until you get your application approval/denial without acruing illegal presence, but be ready to leave in a short period of time if you get denied. Be aware that your filing for an extension will more than likely affect future attempts to enter the states as a tourist, you will probably need to spend a decent amount of time out of the US no matter what the results of your extension request are.

I'm holding a B2 Visa which allowed me 6 months, the visa waiver program...

Tourist visa extensions are usually given for medical or family emergencies. You can stay in the US up until you get your application approval/denial without acruing illegal presence, but be ready to leave in a short period of time if you get denied. Be aware that your filing for an extension will more than likely affect future attempts to enter the states as a tourist, you will probably need to spend a decent amount of time out of the US no matter what the results of your extension request are.

Oh No! sounds like im in a bad position. What about if I apply for a language school to hold a student visa after my extension application is denied. you think that will work?

No, you will need to leave the states if your extension application is denied. When your B2 expires you will be out of status, the only thing keeping you from accruing illegal presence is your pending I-539 application. If it is denied you will need to leave the states or you will start accruing illegal presence. The only time you can adjust your status when you are out of status is through marriage.

Appreciate your help and advice! :) Yes we intend to get married. Since both of us are from Singapore, are we allowed to get married here legally? And thereafter for me to apply for a dependent visa? Thanks!

And also, what if I apply for a student visa now, before my visa expires? But the only problem is that during the process, my visa might expire. :( So ultimately am I right to say that its not a good idea?

Not a good idea, to apply for a student visa you must be accepted into an accredited school first, Fall semester is finished accepting enrollment, you'd apply for winter which will certainly be after your visa expires

Thanks. What about I get married here and apply for a H4 visa. Will that work? And during the process if my visa expires, can I stay and wait for the results of the application?

It will work only if you remain in legal status. In other words, you need to be married and have your H4 application in USCIS hands before your current status expires. You are cutting this really close and I'm not sure what affect, if any, your pending I-539 extension application will have on this process. You may want to make an infopass appointment and speak to a USCIS officer.

Good for you! Are you going to get married and apply for the H4?

Thanks Teddy. I am still trying to find out if I can do so and apply for a H4 here...Tried to call travel state gov but they have no answer.

How did you get a visa extension in 2 weeks I-539 are taking 4-5 months???

Yea, i applied late August. So they took less than 2 mths.
