Hello everyone! I would appreciate your comments in my case.

My story goes like this:

I got married on 2008 but my marriage didn't work out and broke up on 2010. But no legal separation nor annulment filled. I met my Fiance on May 2011. My X husband died due to sudden unexpected nocturnal death syndrome on December 2011. Even I was separated with him I still attended the funeral and burial and even signed as informant on his death cert. My fiance filled K-1 petition on March 10, 2012. My interview will be on Oct. 26, 2012.

What do you think will be the questions for me on my interview. Please give me some of your thoughts! Thank you.

When did you and your ex live seperate and apart from each other ? I mean different address? I think that will be key because on paper you are still married. If i understand correctly

When did you and your ex live seperate and apart from each other ? I mean different address? I think that will be key because on paper you are still married. If i understand correctly

January of 2010 he left me because of other woman whom he had a child.What happened was, He kept asking me to give him a child but I was still in school and I have some hormonal imbalance so its hard for me to get pregnant even I seek medical treatment,that was his reason he cheated on me. I live with my parents when he left me.

The ex-husband passed on. With that, there are no more obligations. Why does it matter whether they lived together or not. Best thing to do is bring a certified copy of death certificate. BTW, I hope that this was on the G-325. If it is, then, I don't foresee any entanglement. BREATHE!

Annulment is a requirement to legally separate from a spouse in the Philippines. He was your husband when he died, and you are now his widow. If his death legally separates you, then the US interview questions in regard would merely be about your previous marriage.

Filipino Family Code:

Art. 13. In case either of the contracting parties has been previously married, the applicant shall be required to furnish, instead of the birth or baptismal certificate required in the last preceding article, the death certificate of the deceased spouse or the judicial decree of the absolute divorce, or the judicial decree of annulment or declaration of nullity of his or her previous marriage.

Seems you would need the marriage and death certificates and be prepared to answer any questions about the previous marriage.
