hello to all

my wife and i have been married for over a year. she entered the US on a K-1 visa.

the follow to join benefits have expired for us.

my question is in regards to filing for my wifes children.

what is the best way to file the I-130 for their CR2 visas?

1. file as a US citizen and as a step parent to the children?

2. let my wife file as a LPR?

all of your replies will be helpful

thanks

Assuming the kids are minors (under 18 when you married), you filing as step dad will be much quicker- about 9 months.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes the kids are both very young.

the only other question i would have is, is it necessary to file an I-130 for each child individually??

my wife has two daughters.

thanks again

Yes, separate for each child, separate fees and bio forms etc. You can send it in the same envelope though.

Its better if the USC spouse is filing I-130 for the kids. That's what we did with my 2kids.

thanks for your reply.

I am the USC and i will file for my wifes children as a step parent.

I will use the I-130 to obtain CR2 visas for the children.

Am I correct?
