I just field the K1 visa on Sept 25. I havent received the NOA1 yeat.

And I would like to cancel the petition because I just found out that he is not ready for marriage when I asked him over and over.

ANd its not really me that he wants to go to in the US its his family. He is not ready to live with me and he keeps on persisting that he wants me to move to california when I really cannot.

There isn't anything you can do yet because USCIS doesn't even know you've sent them a petition. It's unlikely you're going to be able to stop the petition at the Texas lockbox since it just moves through there briefly. Wait until you get the NOA1 and the online status says it's been sent to the service center. Prepare a letter explaining that you'd like to withdraw the petition. It wouldn't hurt to have your signature on the letter notarized. Send the letter, along with a copy of the NOA1, to the service center.

Sounds like he's ready to join his family, but not to get married. You're lucky you found out before you went through the whole process and married him. There are many pitiful stories on VJ from people who weren't so lucky.

Its good he is honest with you, some people would have kept quiet and used you to get what they wanted. Like pp said wait to get the receipt # before you call/ write a letter. You can call them also to get further instructions but you will need that number.

vanessa, sorry to read about this. Others have already provided words of comfort. If you sent a personal check to pay for the form fee, i would recommend you contact your bank to see what you can do about getting the check to be declined, so that you keep from having your money wasted. act quickly.

Looks like OP sent the petition on 9/25 I am sure the check has been cashed and if she tries to stop payment they will probably start collection actions. I believe I seen somebody else on here recently say they stopped payment and are now being asked to pay it.

You can do a STOP PAYMENT on the check. Do that IMMEDIATELY. Call your bank's 1-800 number NOW and ask them to stop payment on it. The government will try to cash the check, when it doesn't work, they will send a notice that payment was incomplete. Then you can write a letter explaining the situation, formally canceling your application, and putting an end to it. It's important to write a letter because if you every apply for a K1 visa with another person, this one will show up in your history. If you don't write, they might perceive you to be unreliable, which you're not - you're very smart and careful.

BTW, I think it's GREAT that you've made this decision now. Better now than years later. Good luck.

She can check online to see if the check has been cashed. If it hasn't, she should stop payment on it.
