K1 questions

First off, thanks for any help that you guys who have been through this can give me...I know these questions are probably in here somewhere but not easy to find.

A little background...I'm in the mlitary and was stationed in Cyprus. I met my phillipino fiance there as she was (still is) working as a nanny/maid there. My first marriage was still not legally over even after years of separation so we could not get married there. About two weeks ago a divorce was FINALLY granted.

I've done the research and think I've got everything ready for the petition to eventually apply for a K-1....I do have a few concerns though.

1. Proof that we met in person. We dated for a whole year, so we have plenty of pics. But I didn't keep any plane tickets or anything like that. I do have my passport stamps.

2. She's in Cyprus illegally as she stayed there past her work visa. Because of that I told her she should return to the phillipines first before filing the petition. She agrees and will be going soon. I guess she will be able to show her passport stamps too...will the stamps showing a long stay in Cyprus set off red flags with USCIS or the State Dept, or will they not even look at that?

Any suggestions?

Also, the process seems pretty cut & dry...but do any of you suggest going through an agency to help? If so, which one(s)?

One more thing - assuming everything we submit is done correctly, how long of a process am I looking at to get the visa issued? From everything I've read I'm guessing approx 6 months?

Since she spent time in Cyprus - later on - not now for her embassy appointment for visa she will need to have her Cyprus police clearance. So you have to figure out how to attain this. And if she is there illegally, there might be some issues to obtain this.

Do you have any bank statements that show your use of ATM cards in the Philippines? What about boarding passes, hotel bills etc.

Make sure to submit about 5 or 6 pictures with various settings. At the back of the pictures put the location, date and who are in the pictures.

And the process is cut and dry.No need to waste money on lawyers or agencies. This process can take 6 months or more depending on how backed up the service centers are.

Processing time varies between CSC and VSC. You can handle all of the paperwork yourself. Make sure you have a certified, signed divorce decree.

There is no need for her to show her passport as proof f relationship. As far as other evidence, phone records, plane ticket receipts, frequent flier monthly statements. Read the thread on how to apply, it will help..

The visa petition process may take 5-7 months, depending on several variables, including the assigned service center workload, and no RFEs or other possible documentary delays (such as, Cypriot police certificate). The ENTIRE visa process may take 8-10 month, not considering any delays, RFEs, or miscues. Check recent timelines for more current estimates. YMMV

Good luck on your visa journey.
