Losing F-1 Status while AOS is pending

Hi all,

I filed for AOS after married my wife who is USC. We have our AOS interview scheduled on the 3rd week of Oct in Chatsworth, CA. My question is.....I gave up my F-1 status while I was waiting for my EAD card. I'm in graduate program. I already completed all the classes for my program but just needed one more semester to prepare for the grad exam at the end of this Nov so I just registered the 1 unit PE class with an International office's approval. The problem is that I missed that 1 unit PE class many times and I had to reinstate my I-20. (My instructor gave my grade as "class withdrawal without notice). My attorney said that it's ok to give up F-1 status since my AOS is filed and waiting for my interview.

I'm a bit worried that how or what should I answer at the interview if they ask me why I gave up my F-1 status. Please let me know if any of you have or had the same situation.

You will be fine. I was out of status for 3 years and it wasn't a problem for me. I was asked about school and all at my interview. Just be honest if asked about it....

06.08.12 - AOS mailed
09.18.12 - Interview.....Approved!!

ROC- Divorce Waiver
05/09/14- I-751 packet mailed to CSC
05/12/14- NOA1 Receipt date
07/01/14- Biometrics Appt

08/11/14- RFE received

09/08/14- RFE response received by USCIS

09/22/14- 10yrs GC Approved!!

Timeline

I think it's okay because you are already on the process of adjusting your status.. That's the whole sense of adjusting into a permanent resident by marriage to a USC so that you can legally stay in the US without worrying if you lose your non-immigrant visa.

I'm glad that I found someone who had an interview at the same office. I'm very nervous about my interview and your post just made me feel better.

How was your interview? Did it go well?

That's my interview experience. The interview itself last no more than 5 minutes. Very easy.

I read your post before but didn't know that that office was the same one that I'm going to have my interview located in Chatsworth. My interview is at 8:30am. It's too early morning but hope everything will go well.

The bigger issues would likely be with your ability to complete your degree. My wife's institution requires continuous enrollment.

4/1/2013: First Green Card from November finally arrived...

4/22/2013: Replacement Green Card arrived.

8/9/2014: Filed I-751

8/14/2014: Received NOA for I-751

3/12/2015: ROC Approved!

7/18/2016: Sent in N-400 to Texas lockbox

7/21/2016: N-400 delivered
