Tax returns for AOS

Hey everyone! So, I have my husbands W2's from 09, 10 and 11 but he is on a payment plan with the IRS...will it be okay if I send in the copies of the W2's and proof of a payment plan??

One tax return is required. It's got information and is backed up by what the W2 says. They aren't asking for a receipt or proof that he paid the tax burden. They want to see the tax return + W2 (or a tax transcript on its own without W2) to establish his income.

Later on for the citizenship application they want proof of paying taxes, but the income level doesn't matter--just the opposite.

Are sending in complete tax returns (i.e. Form 1040, Sch. A, ....etc.), or tax transcripts? You should really consider submitting tax transcripts, USCIS readily accepts them. They are available from the IRS without charge. I was able to order mine online and obtained them ~10 days.

i don't think he will get the return until he has paid them off so do i have to wait until then?

There is no way he or they would know what he owed until he filed a tax return. The tax return comes before the paying (or refund in many cases). It's an IRS Form 1040 (or 1040A or 1040EZ). Then there could be Schedule A, Schedule D. or various other add ons depending on the source of his income, interests or dividends from investments, self-employment, etc.

The tax return is his way of saying My name is ___. I live at ____. I am __single __married, I have ___ kids, I earned $_____, so my tax comes to $_____. My employer held out $____ from my paychecks, but it wasn't enough so I still owe you $_______. If he couldn't write the check to pay the balance, he still needed to file the form by April 15ish and keep a copy for himself. (He makes a photocopy of his copy for USCIS.) Then he works out how he's going to pay the bill, but that has nothing to do with what the USCIS needs to see for AOS.
