Hello VJ,

Please help I need all the info I can get I hope I am posting in the right place. I dont know where to begin. We were just married a month ago we have been together over 1 year. My husband came on a visitng visa over 5 years ago and overstayed. How do I start the visa process what do I file for what paperwork and what do I need to do first? Any help or advice would be greatly appreciated.

Hello VJ,

Please help I need all the info I can get I hope I am posting in the right place. I dont know where to begin. We were just married a month ago we have been together over 1 year. My husband came on a visitng visa over 5 years ago and overstayed. How do I start the visa process what do I file for what paperwork and what do I need to do first? Any help or advice would be greatly appreciated.

I'm assuming that he's in the US right now, if so you need to fill out forms I-130 Petition for alien relative, I-485 Petition to adjust or change status, G-325A Biographic Information,I-765 Employment authorization(if he wants to apply for EAD) I-131 Advanced Parole(If he wants to travel before his green card is granted), I 864 Affidavit of support. Get all those forms together read instructions carefully and acquire the supporting documents requested. After everything is filled out, signed and dated you mail it to the appropriate address and sit and wait for a response from USCIS:-)

P.s Under no circumstance should he live the U.S between now and the time he receives his green card cuz he'll be banned from re-entering for possibly 10yrs. Good luck

I read somewhere on here that even if I file the I-130 that since he overstayed his visa he can be deported even though we are married. Is this true? He did not visit with the intent to overstay his visa and this is 5 years later that we married. Should I be concerned? Should I seek an immigration attorney (I really cant afford one) what do you guys suggest?

I read somewhere on here that even if I file the I-130 that since he overstayed his visa he can be deported even though we are married. Is this true? He did not visit with the intent to overstay his visa and this is 5 years later that we married. Should I be concerned? I believe overstay is forgiven as long as he adjusts status and doesn't leave until he receives his green card. Someone will correct me if I'm wrong.

You would want to do both at the same time. Filing I-130 alone doesn't give him any immigration benefit and he can be deported at any time. Filing the I-485 with would give him a new Authorized stay until a decision is made on his Greencard...

Well those circumstances are concerning. Sounds like he was supposed to be deported but is avoiding it. There's a potential problem if they got married after he was ordered out of the country. OP, was your husband ordered to leave? Do you know? If so, you might need an attorney.
