I am not in USA, and I currently in my process for residency, obtained through my older daughter who is a USA citizen. The problem is I have a 7 years old girl. My and my husband have to go in a couple months for our interview, and then we have to flight to USA.

I do not want to leave my daughter behind, or having to wait 3 years. I wast thinking in asking for a student visa for my 7 y old daughter and after I become a citizen her status would change automatically. Is there any chance they would aloud it?

With the country you're showing here it maybe even more challenging. Its not impossible. Keep in mind that U.S. public schools dont issue F1/student visas. You will have to get her into a private schools.. which could run you 5000-9000 every 6 months.... certainly not cheap. My brother who is in the same situation as your child was considered for this as well. Even with the acceptance into the school that is no solid reason for at the interview for a visa approval.

The husband can go to the US first and then you and the child can come later.

Unfortunately, student visas are not available for elementary school.

Who petitioned for you? Did your husband file for you? If yes, then is there a reason he did not file for your daughter?

There is no chance that will be allowed.

Student visas cannot be issued to 7 years old for public school.

There is no way for you and your husband to immigrate together with your 7 years old.

What other people have done in situations similar to yours is have one parent immigrate first and the other parent waits to immigrate with the child. Your husband can immigrate first while you wait with your daughter. He files for you and your daughter. In 3 years, you and your daughter immigrate to the US to join him.
