NVC sent my petition to the Brasilian consulate (Rio) on 10/26 (23 days after NOA2 was approved). YAY

What I expected to happen at this point wwas;

1) Brasil consulate recevies I-129F

2)Brasil consulate send Package 3 to Renata

3) Renata sends to the consulate DS-230, DS 2001, a copy of her passport and a photo (after she is in possesion of the necesary police certificates

4) Consualte schedules interview

The RJ consulate just repsonsed to a few questions I had, and told me that the consulate will schedule the Interview once they receive the petition from the NVC

"AS SOON AS WE RECEIVE THE CASE HERE, WE WILL SCHEDULE THE INTERVIEW."

So, now I am wondering why I thought what I thought above (I can't go back to find the source, but from my reading of the guides, messages and other peoples timelines over the past year, this is what I thought was correct). Regardless my questions are:

- Will the consulate schedule my interview upon receipt of the petition?

- How long should I expect for the consulate to receive it

I think whoever responded to your email may have confused the K-3 with the CR-1. Interviews for the CR/IR visas are scheduled once the embassy/consulate recieve the package from NVC and then an interview packet (packet 4) is sent for the applicant. For K-3, once they receive the approved I-129F package from NVC, will send out 'visa application packet' (packet 3) which includes the DS-2001 which along with other things required is submitted to the embassy/consulate in order for the interview to be scheduled.

From their website

Spouses, fiancees, children under 21, and parents of US citizens are immediately eligible for an immigrant visa interview once their petition is approved. The interview will be scheduled after the Consulate receives forms DS-2001 and DS 230-1 and all internal clearances are completed. The complete immigrant visa process, in these cases, takes around 5 (five) months. If your petition has been filed with USCIS in the U.S., please allow an additional six weeks for the petition to arrive at the Consulate in Rio, after it is approved.

I think that most consulates schedule interviews when they receive the package from the NVC but will then send the final forms to your wife, and then when those are posted back will send your wife the interview letter.

at least thats how it worked for me from Australia.

Well i can tell about my case... they received (after a long NVC game with us) my petition in august and guess what - they never sent my the 3rd package ( im on the k1, but it doesnt matter, its the same to all petitons)

So i sent it by myself with the instructions that i found on the website and i sent everything...

Do you wanna know when did i get it? September, after the 4th package. :angry:

And they just set the interview date after you send the 3rd package filled out.

So if i can tell you something... As soon as you know that they have your papers, send them the papers before get it.

Take a look at my timeline and u will see what happened to me. My case is also a K-3 from Brazil and I have my interview scheduled to november 12th.

Don´t worry Brazilian embassy is super fast.

i think your case is a little different since your 1-130 was approved only a few weeks after you sent your I-129. My I-130 has been sitting in Vermont since So, in this does the I-130 supercede the I-129?

Also, I was told by the consulate that I need to use the I-134 support form, when in fact, I think I need to use the I-864, especially if my I-129 keeps moving and the I-130 stands still. Which one are you using?

First, the I-130 and the I-129F are two seperate processes. The only connection is that an I-130 has to filed in order to submit the I-129F. The only time an approved I-130 affects the I-129F for the K-3 is if the approved I-130 reaches the embassy/consulate prior to the K-3 interview. In that case the I-130 and application for the immigrant visa over-rides the K-3.

The I-134 is used for K visas

The I-864 is used for the CR/IR visa and when adjusting status in the US from the K-3.
