hi everyone,

I am a us citizen and my fiancee from philippines is already here with me in america.We are now married and need to change her status and apply for employment authorization.anyone who has an idea on what to fill up on number 16 question on I-765 Application for employment Authorization,is it (a)6 or ©9 im really confused...help...we need need to file this form ASAP before her visa expires on oct.10,2012...she entered USA in a K-1 visa

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You already got the answer for question 16.

As a side note, a K1 visa is good for one entry into the US only, and is cancelled when the alien enters the US. The expiration date on her visa is no longer relevant. The expiration date on her I-94 card (which should be stapled into her passport) determines when her status expires, but even that date isn't critical. There is no deadline by which a K1 must file for adjustment of status. The only requirement is that you marry within 90 days. Of course, there are a host of reasons why it's better to file as soon as you can, but her eligibility to adjust status will not end when her I-94 expires. She will remain eligible to adjust status as long as she remains married to you.

In other words, don't panic if you can't get the AOS submitted before her I-94 expires.
