Fiance Visa Advice Needed

If you VWP visa is only 1 mth, it will be hard for you to show that you had non-immigrant intent before you came here as most people recommend waiting atleast 30 days before marriage.

Dangerous to listen to your advise friend.

Visa Waiver Program "visa"? :lol:

The whole point of this program is to waive the visa requirement and yet you've got a visa for this VWP huh? :lol:

And to the best of my knowledge, it's 90 days, not 1 month. You're allowed a stay of up to 90 days when coming through by using the VWP.

07/10/07 - Sent I-485 via USPS Priority Mail to Chicago Lockbox

07/23/07 - Received NOA1 in my home mailbox

08/13/07 - Received ASC Biometrics Appointment Letter in my home mailbox

08/16/10 - Sent N-400 to AZ Lockbox via USPS First Class Mail with Delivery Confirmation

08/18/10 - USPS Confirms delivery: August 18, 2010, 9:57 am, PHOENIX, AZ 85036

08/24/10 - Check #501 for $675 cleared my account @ 11:20 pm EDT

08/27/10 - Received NOA dated 8/23/10 with a Priority date of 8/18/10

09/07/10 - Received Biometric RFE dated 9/3/10 -- Fingerprint apt. schedule 10/1/10

10/01/10 - Fingerprint Appointment-- Completed

10/09/10 - Received Interview Appointment Letter dated 10/6/10 for scheduled interview on 11/09/10

11/09/10 - Interview Passed

11/18/10 - Oath Ceremony

When I saw a lawyer, I, too, was told the bogus information that you were given. She worded, very 'hush hush' and sneakily, that he should come for a 'visit' but be sure not to mention he was coming to marry me, then we could 'decide' to get married while he was here, and we could have the lawyer help us adjust our status.

The reason we originally went to her was because our biggest concern was whether or not my mother could be a co sponsor as I have been unemployed for quite some time (I am the US Citizen), and we weren't sure whether my mother could support due to her being on workmans comp and other retirement issues. The lawyer also suggested the 'easy' route saying that that way, it wouldn't even be an issue, basically saying that we wouldn't need any of this 'sponsoring' stuff.

I, too, was extremely happy hearing this, though I was slightly dubious, because if this was truly the case, wouldn't more people be doing it? And the way she acted like we should be very secretive about what he says when he arrives? It didn't sit entirely well with me after thinking about it for a few hours.

So I posted on VJ asking for other peoples advice much like you did, and the resounding reply was 'Run away from that lawyer as fast as you can.'. I went with my gut and agreed that she was telling us to do something that wasn't entirely kosher and that could possibly lead to more trouble than it was worth, things like causing him to be deported among other things I was told at the time.

For awhile, the whole disappointment put me off filing the K1 because the process seemed so daunting and I was sure I couldn't figure it out myself. Eventually I found the sample papers here on the site (They weren't around before when this issue came up) and using them, the paperwork was a breeze, and here I am waiting on my NOA2. I have to wonder why I put it off for so long, honestly.

Just to be completey sure, the co-sponsor for my Fiance, has to fill in a copy of the I-129F also, and I, the forein fiance needs to fill in a copy of the G-325A form, and my fiance will send them all in the same package together?

Do we highlight "Naturalisation" or "Other" - I-129F Petition for Fiance ??

I've read the guides, and that is where my question stems from. On the sample form 'Naturalisation' is crossed, and I really just wanted to double check that's right.

You may need to upgrade your Adobe Acrobat. The sample form (to me) shows 'Other' as checked, and then I-129F Petition for Fiance(e) filled in the box next to it. That is what you need to select if doing a K-1.

oops, sorry about the adobe mixup!

About the above, no, none of that is right.

A second sponsor will complete their own affidavit of support (financial paper) that you will take to your interview.

To get started, you need your USC to complete I-129f to tell them that she is a USC, she's seen you in person in the past 24 months and you plan to get married. Then wait. :)
