Extending Spouse Visa Expiration Date for POE

My wife recently had her Spouse Visa Interview (CR-1) at the American Embassy in Seoul, Korea. She was approved! The Immigration Officer explained that her visa will expire in less than 6 months. However, my wife can get another X-Ray done and the visa can be extended. We are thinking about getting her X-Ray done again in a few months to extend her visa expiration date. If we do that and extend her visa to May, that will be the 2 year anniversary of our marriage. Would my wife automatically get a Green Card for an immediate relative once entering the POE in America? I always thought that she had to be in America within 6 months of the Interview. Was I wrong on that assumption? Would I be better off extending the visa until May so she can skip the Conditional Residence period?

It seems strange to me that you would live apart for another 8 months to save a few hundred dollars and not file the I-751 form.

All it is some paperwork to be filed at the 2 year mark of residency. If skipping that filing is important to you then wait.

Why would your wife need another x-ray?

Visas can be re-issued for another 6 months, but you need a good reason. Medical treatment would be a good reason, but having an x-ray just to extend the visa is not.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Sorry for the confusion. At first we are planning to move to America on March 2013 (We are both currently residing in SK). However, we just thought of the idea of extending the visa so we can fly out of the country (and go to US) on May 2013 in which will be our 2nd anniversary. Will that save us from filing the I-751 form? or the 2 years of being married is not based on the POE but the date of Visa interview?

The immigration officer told us that I can extend my visa if I just get another chest x-ray. Then I have to submit the x-ray and my passport to the US embassy and they will extend my visa for another 6 months. We never thought that this is possible until he told us this. umm.. He noticed that my husband's work contract will end on March 5, 2013 and my visa is will be expired on the 7th. Not sure that is the reason why he mentioned this to us.

----

Even if you get the xray you won't get to May it will be for 6 months from the interview.

I really thought that is the case but the immigration officer told us that my visa is tied up with my chest xray/medical date. . I had my medical last Sept 7 2012 and my interview last Sept 27th.. My visa will expire on March 7th 2013.

I am not sure the immigration officer was telling the truth.,... I would definitely double check and get something in writing if you decide to go that route.

He printed a letter in a blue form. He signed it and told us to ignore what it is written there and the reason he gave us that is for the visa extension. That I have to go back to the embassy in case we decide to extend my visa. Here is some of the excerpts of the letter.

This office regrets to inform you that it is unable to issue a visa to you because you have been found ineligible to receive a visa under the following sections of the immigration terms and Nationality Act. The information contained in the paragraphs marked with x pertain to your visa application: Please disregard the umarked

x Further consideration will be given to your visa after you obtain and present the documents listed about and or the following:

Visa will expire on 7 March 2013. If leaving after that date, please go to Hospital and get and updated chest xray and submit it and the passport to the US Embassy

He told us to ignore most of the part except the bold part because he used a visa refusal standard form for this. He signed at the end of the paper.

Any thoughts?
