Hi guys please help me out with a few questions, my husband and i are trying to complete our paper work and file everything by the end of october 2012. but we are so confused about the forms i-765 and form i-864, for the I-765,i dont know what to fill in because i already have a work permit for OPT from my school because i am in F-1 status international student so when i graduated i applied for OPT and was given a work permit which lasts one year and its almost expiring but now that i am filing for AOS on the I-765 should i apply for a renewal or apply for a new employment authorization card because as i go further with the questions it asks whether i have ever applied for employment authorization before but i am confused as of what to fill in because i am scared if i say no they might find out that i already have one and if i say yes the process of getting a new one might get longer......so anyone with an idea about this please help me out....

and then on the i-864 my husband can not sponsor me plus he has been filing his younger sister as a dependent over the past years so does that mean we are in a household of 3 and we managed to get a co-sponsor but now that co-sponsor has a family of five including him so if he is to sponsor us is he supposed to have the requirements of a household of 8 including my husbands sibling or not and what really do we need from the co-sponsor does he fill out a separate form and provide proof of his taxes what else because i am scratching my head over this like crazy and am desperately seeking answers.

so far that is the only problem that is holding us because we are so confused.

For the I-765, it will be for a new EAD and put (c )(9 ) for the code on question #16.

Yes, your husband needs to meet the requirement for a household of 3. A joint sponsor only needs to meet the requirement for their own household size plus the intending immigrant. See the I-864 instructions for how to count household size.

Thank you so much for the response i just have one more question on the I-765 what should be the answer for no.11 since it asks whether i have ever applied for employment authorisation and knowing that i already have a work permit. Am thinking the answer should be yes but am confused since i will be requesting for a new one. Thank you so much for your help....

You did/do have a work permit before, so you would say yes and answer the follow-up questions about which office you applied to before and the date. The instructions say to include a copy of your previous EAD front and back too. You are asking for permission to accept employment instead of renewal because this is a different eligibility category you are applying for this time. This time you are an Adjustment Applicant.

**** Moving from AOS from Family Visa to AOS from Student visa ****

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
