Hi y'all...

So my husband (USC) listed me as his spouse in 2011 when he filed his income tax in April of this year by mistake. We were married on Jan 3,2012. Now We are almost ready to send off the i-864 with his 2011 (with the mistake), 2010, 2009 returns. Should we fix this before sending it off? Does it really matter??? Please any advice would be helpfull.

I would bring a notarized letter swearing under oath the tax filing was a mistake and will be rectified if you can't get it done before you need to make your appointment. We had a similar issue, and they seem to be understanding if you come fully prepared and organized. Although every officer is different!

Amend the tax return. If your husband listed you as a co-filer, then he got a bigger personal exemption and deduction for you which lowered his taxes. He needs to amend his return and return the money to the US Treasury.

File the amended return with the I-864. The NVC will never know that your husband filed an incorrect tax return with incorrect information.

Hi thanks for your response....We have not sent the i-864 yet...Should we send it off as is (with the error) while the correction en send the correction? Or should we wait until it is fixed and then send it?

So then you would recommend holding off on sending it and wait for the correction?...I wonder how long that will be....grrrr
