I was in canada on a Non immigrant visa and I happened to overstay there. Do you think this will cause the denial of my K1 visa to US? We've got our NOA2 but Im not too positive for the interview.

Someone please correct me if I'm wrong, but I don't think the U.S. will check with Canada if you had an overstay...

10/07/2006 WEDDING DAY!

11/14/2006 AOS packet made it to 'the box' after being overnighted.

12/02/2006 Paul had biometrics

12/14/2006 AOS Forwarded to CSC AND AP Application approved.

01/17/2007 First touch of 2007 at CSC

01/20/2007 Touched AGAIN (also the 18th) come on...

February: Oops, RFE for a REGISTERED marriage certificate. Oops! Overnighted it.

02/28/2007 Paul gets email letting us know his GREENCARD is on it's way! It's done...for now!

03/09/2007 Paul's greencard arrives. And breathe...

We began with mailing the I-129 in on February 27, 2006 so the whole process took us approx. one year.

I don't think that they will consider your overstay in a different country, only if you overstayed in the USA. How long was your overstay in the "Great White North"?

Interview in Guangzhou? If so be prepared for the slowness of that consulate!

Thank you all for your kindness. I think US side knows/ will know my overstay in canada cuz my boyfriend visited me many times when I was in canada and we never hide anything. We just wanna be honest and keep it simple. We're just ordinary people who want to be together and settle down since we've having this relationship for couple of years.

Ill try my best at the interview for I believe we deserve being together ( yes, China consulate is pretty slow, but we must be patient and respect their work.)

I think you are overestimating the "reach" of the US agencies involved, but I'm wondering if you put your address/dates of residence in Canada on your G-325A? Do you need to and are you intending to provide a police certificate from Canada? I think that's probably the only way US authorities would see there's an issue there, unless you volunteer the information.

Another thing I visit Canada for many different reasons, they do not track them, they only verify that I am a US Citizen by asking for and looking at a photo ID or other document proving citizenship, nothing gets entered in to the system. Americans can visit Canada with out passport.

So his visiting you in Canada wont be a factor either. I don't think a Canadian police report should not show anything either.

So have no worries ,you should do fine. :yes::D

Before I even started our process I was on the phone for over an hour with the Immigration division and I was assured that being deported from another country and being illegally in another country was not an automatic no for the US. They are only concerned if you were illegally in the US or deported from the US.

Thank you guys. You do ease my worries.

I was not deported, hehe. I didn't stay there intentionally, only that if I stayed there it would be easier for my boyfriend to visit me. Well, it turned out to be trouble for us now. But thanks to your information, I think we still have a fat chance getting the visa. We applied k1 right before I left canada. ( My canadian visa was good for more than 2 years). I was there for nearly 3 years and my bf visited me 5 times in total, before we filed for k1, he visited me 3 times in a row. And we have this relationship even more than 3 years. I hope the visa officer would be able to understand this and don't make a big deal out of my overstay in other country. We are just 20 something, first marriage. But if for any unexpected reason they want to reject me, it could be an good excuse, so they can bar me for a reason. I know it's their job to be strict but I do hope they have some compassion. It's already very tough for us being apart while deeply in love.

Yea, I'm gonna obtain the police certificate from canada. I didn't have any criminal records. I hope this would not be any trouble. Cuz I know I need this at the interview. Even though US consulate will know my overstay, I will have to be honest, cause me and my bf met in person in Canada, most evidences we have are from the life in canada. Besides, they'll have my passport. Hehe.
