Filing Fees for I-130's

Timeline

My wife would like to petition for her two brothers, two sisters and three of their children to live in the United States. I believe that this will require four separate I-130's and that each one will cost $420. Am I correct in assuming that or will it only cost $420 as if filing just one I-130?

Also, when filing, do four I-130 require completion or can a single I-130 be sufficient?

Yes, she gained her United States Citizenship. Seriously? $420 per applicant? So, for the two brothers and two sisters that comes out to $1,680? What about the three children? Will it cost $420 for each one as well?

The children will be under the parent aslong as they are under the age of 21 You'll are aware that it is a 10-12 wait for siblings.

The fee is $420 for each I-130 filed. You wife can only file for her 4 siblings. That's four separate checks for $420. Do not send one check for $1,680. Each case is separate. They are not processed together or anything like that. Each stands on its own.

No where can you get 4 times the work for 1 fee. My mechanic doesn't charge me for 1 tire when he works to install 4. When he works to install 1 tire, then he would charge me for 1. When he works to install 4 tires, he charges me for 4 tires.

Your wife is sending in four separate I-130. That justifies a separate fee for processing each I-130.

She cannot file for her nephews or nieces. Her nephews or nieces would fall under the petition for his/her parent. The children would be derivative beneficiaries who can lose their status during the 10-12 years wait. Only unmarried children under age 21 as calculated under CSPA at the time the Priority Date is current (in 10-12 years) will be eligible to come with the immigrating parent. If a child ages out (turns 21 during the wait), the child may not be able to immigrate with his/her parent.

When the petition matures in 10-12 years, it will be separate DS-230 immigration fees for each person.

Logic should dictate that if the child is under the age of 21, the petition should go through for the child as well. Consider this, you've purchased a car, it has two weeks on the warranty, you take it into the dealership, the dealership keeps it for two weeks and two days before performing service then charges you the full cost of the repair because now the car is out of warranty.

The petitioner is not getting penalized for anything. The petitioner is asking that his/her sibling be allowed to immigrate to the US. This request is not a command. It is a request. There are rules for these requests. Rules that protect all US citizens, and not just advance the goal of one family to immigrate to the US.

Immigration is a privilege. It's not a right for a foreign national to immigrate to the US.

Your 2 weeks 2 days analogy is faulty. It is not processing by the US government that results in delays. It is the sheer volume of people like your wife's siblings that causes the delays.

The US has about 300,000,000 people. We let in 1,000,000 new immigrants every year. There are more than 1,000,000 people waiting for the opportunity to immigrate to the US.

Priority is given to the spouse, parents, and children of US citizens and LPRs. Siblings of US citizens are the lowest priority in immigration.

About 65,000 visas are reserved for siblings of US citizens each year. There are over 700,000 people waiting. That's a 10-12 years supply of people.

If you would like to rework our immigration system, what would you propose to do? Bring in more than 1,000,000 immigrants every year? Immigrants who will apply for more foreign family members. Exponential growth???? One bring two. Two bring four. Four brings eight. Would you allocate more visas to siblings from the other categories?

Everyone wants their relative here faster. They want more family members to be able to immigrate. Where the heck are we going to house and feed these people? Where will the jobs for them come from? How can it be justified to bring in more foreigners to compete with all those unemployed US citizens?

I think a 1,000,000 new immigrants every year is pretty generous. No other country takes in more immigrants than we do.

I am waiting for relatives too. Relatives in the F4 category. So, I am in the same boat as your wife.

It seems that lots of people feel the immigration system is unfair when they are told that their relatives have to wait or may not be able to immigrate. Most don't realize that the system is set up to protect us, the 300,000,000 US citizens, from a flood of immigrants if we let everyone in as soon as the ink dries on the I-130s. We simply can't survive giving out more visas annually. Could you imagine letting in 5,000,000 immigrants every year? That's the population of Los Angeles. Where would we house them, feed them, and provide jobs for them?

The system is not broken in my opinion. To me, it seems that it's only broken to some when someone is told to wait.

The Child Status Protection Act (CSPA) actually provides that the time that it takes for USCIS to process the I-130 is not counted against the derivative children. It is the sheer volume of people like your wife's siblings that causes the delays. It is waiting for all those waiting ahead in line that causes delays for those behind in line.

I beg to differ, the system is broken when a soon to be mother arrives on a flight from a foreign country, gives birth to the child in the United States, and therefore is allowed to reside in the United States. I have nothing against waiting in line, I do have issues with line jumpers though and those that avoid the line to begin with.

Yes, the baby who is a US citizen by virtue of the US Constitution can stay. Mom who is a foreign national does not get to stay in the US legally. So, mom does not get to reside in the US. And no way is mom going to leave her US citizen baby behind. If she does, it's extremely likely that the baby would be put up for adoption which would terminate that parent/child relationship thus making immigration impossible.

If you are talking about line jumpers who come here illegally, then yes - the system is broken when so many can slip through the border. If mom is living here illegally, then US baby or not doesn't seem to help her at all since she can't become legal through her US baby.

So, getting back to the subject of how is the system broken for those coming here legally? What would you like to see happen to shorten the wait for your wife's relatives?

It is not the time that it takes the US government to process the I-130 that creates the 10-12 years wait time, but the sheer number of applicants and a limited number of visas.

Under the Child Status Protection Act, it is even advantageous for a slow approval of the I-130 since it offers a child more protection because the time it takes to process the I-130 is not counted against the child. If USCIS takes 5 years to process the I-130, a child would age out at age 26 (21 + 5 years at USCIS). If USCIS takes 1 year to process the I-130, a child would age out at age 22 (21 + 1 year at USCIS).

So, what would you do to shorten the wait for your wife's relatives? Increase the number of visas, thus increase immigration? Take visas from other categories?

As a USC I often wonder if ppl were allowed more easily to visit this country but measures in place that makes it impossible for them to

get a job, go to any school, or gain healthcare unless its for accidents, gunshots, heart attack, stroke & appendicitis (on emergency level only)

dont U think ppl would not use their last hard earned cash to come here, and would'nt this keep out undocumented folks?, along with this a

national ID system where there would be checks while driving walking riding, just a wonder. The US would save money on schooling & healthcare

for an overwhelming amount of undocumented ppl. I also notice that some ppl who have come in and is now legal would like to close the gate

behind them......

That's why in lots of SE Asia countries more and more people turn to "marital" Visas for much faster waiting time compared to immediate relative immigration Visas.

When someone's age is about 22-25 years of age and the waiting time is around 7-8 years (being sponsored by their own LPR parents), it would make a lot more sense to get married with a USC and cut the waiting time SIGNIFICANTLY

......and this brings in the "unwanted" byproduct as result, marriage fraud for immigration purpose!

So just like almost anything else in life, don't work harder, work SMARTER....Wink, Wink.
