Hello! I filed the I-130 for my husband through the California Service Center and our reciept date is June 18! We are planning to leave for his country of Peru in a week and take our son to visit his grandma! I was wondering if this will affect my processing and what will I need to make the process as less-stressful as possible! I really love these forums, they provide me with a lot of help! Thank you all!

Are you moving or are you visiting?

Did you file to adjust your husband's status with Form I-485? If yes, then did you file for AP?

Where is your husband living? His permanent address. Where his job is located.

We are just visiting, we should be there for at least 3 months. We are hoping that everything gets approved and he gets his interview while we are there. He is not adjusting status. He is here on a C1/D visa working for Carnival Cruise Lines out of Miami, FL. He is not here illegally and has nothing against him. We were married almost 2 years ago and just now filing our papers after our son was born. We have done everything legal as far as not going against his visa and my husbands "legal" address is in Peru.

and I could never understand why they didn't just let him file here and adjust status on a C1/D. Makes everything more difficult! It seems like its the only visa that can't be adjusted! :(:unsure:

Please don't be offended by my posts. I am not accusing you of anything or making any judgment. I just needed more information.

Since your husband has to process his visa in Peru and his stay in the US was legal and he doesn't have to worry about AP since he is not adjusting, you have nothing to worry about. Leaving the US is fine. Just make sure that you have someone checking your mail and be on the lookout for an immigration paperwork.

Oh no no no!! I wasn't accusing! I just didn't give the full information! That is important to know when talking about this information!! :innocent: I am able to do all of the NVC processing online? I have been reading that and I was not aware of that! What information should I bring with me abroad just in case I may need something while I am there? Thank you SO much for your help!

You will need to send in original or certified copies of supporting documents with the I-864 and DS-230. I don't think there is a way to scan and send them in online.

Tone is so freakin' hard when reading a post on the internet.
